Hello all. My wife and I went to our AOS interview a few months ago and she was approved pending the FBI background check (still no word). Anyways, this last week we went to the DMV (this is in California btw) to apply for her drivers license since she has an EAD and social security card. When we got there, the woman working there told us she couldn't allow my wife to take the test because the name on her EAD card (maiden last name) and her social security card (which has her married last name, mine) didn't match and that the name on one of the documents needed to be switched to match the other. Either that or we needed some other type of "official" picture ID that had her married last name.

Needless to say, we were pissed. I can completely understand why they need the names to match, but if this AOS process has taught me anything, it"s that even something as simple as changing a name on a card was going to be a complete nightmare. We then proceeded to the local social security office where we were told they couldn't switch the name on my wifes card since it was legally her name now. When we had initially gone down to the social security office to get her card for the first time, she had the option of using her maiden last name or married last name and she chose the latter. This choice has now come back to bite her in the behind.

What possible recourse do we have at this point for her to get her license? Since our AOS was filed under her maiden name, will they even allow us to change the EAD card to her married name? Where could we even go about doing this? The EAD card is one of the only (if not the only) picture IDs she has (her visa ID was taken during the interview). Is there a way to get a California ID with just the social security card and then use that as the picture ID required to take the driving test? Thanks everyone.

Why is her EAD in her maiden name??? if she planned to use her married name she should have filed for her AOS in her married name.. that way her EAD and eventually her Greencard will be in her married name....

The only thing you can do is make an infopass appointment and request that the name is changed on her paperwork so the once approved her greencard will come in her married name... if you wait until after the Greencard has been issued you will have to file form I-90 and pay $370.00 to get her name changed and a new card issued...
