hello all,

any help is appreciated............ my question is;

On the I-485 form, part 2 "application type", I am not sure which box to check? My wife just arrived here on a K 3 visa. I think it is (a), but not sure as the example form was for a K1 filer. Oh, one more question. a while ago i recieved a 485 or 864 AOS fee notice, but I remember reading not to send payment until after the 129F process was complete and could wait for the AOS process? Is that still correct? BTW, just got a PC so will attempt to put a timeline up soon. Thanks for your help, dave and diep

I'm not sure I understand your question about fees, but this is how it works:

-You've already filed for and obtained a K-3 visa, and your spouse is here, so that's over with.

-You now need to apply for AOS, which costs $1010. Fill out the forms, then enclose a check for that amount with your application. That's it!

Don't forget to apply for EAD (I-765) at the same time if your wife would like to work (or get a SSN or driver's license) before she gets her green card.

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

Good question. Yes in the example form, c) is checked, for K1 visa applicants. I hope someone who is applying for AOS with a K3 will answer your question. :unsure:

The fee that you were sent before would of been paid had you decided to not do the AOS here but continue with CR/IR processing. Fees now $1010 which includes EAD and AP.

The OP was specifically asking about adjusting from a K-3. Difficult to answer your question without more information. How did you enter the US? What's your status?

well, i am a US citizen, my husband entered as a visitor from Canada, and we decided to get married while he was visiting. now we are applying to adjust status.
