Timeline

Okay, my husband isn't even here yet, but he is worried about how long it will be before he can work.

Does anyone have a clue how long it's taking to get the EAD issued?

How long to get a social security card?

Can I claim him this year on my taxes?

Approximately 2-3 months after sumbitting the paperwork for the EAD. A K-3 cannot get a SSN until the EAD arrives.

And yes you can both file married jointly whether eh has income or not.

8 April 2009 Biometric notice arrived by mail

24 April 2009 Biometrics scheduled

26 April 2009 Touched

...once again waiting

1 September 2009 (just over 5 months) Approved and card production ordered.

Tammy do you file head of household now? Before filing married jointly I would do it out on paper both ways to see which will be more beneficial to you. If you file head of household you can still continue to do so this year since he was not residing with you for the majority of the year.

EAD timelines seem to fluctuate from what I can tell, but to be on the safe side I would tell him 3 months.

12/28/06 - got married :)

02/05/07 - I-130 NOA1

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.

Just a little question....

How can one file either married filing jointly or head of household if the spouse doesn't have a SSN?

One can get a TIN (tax ID number). Check out the IRS website. Good Luck

I think you would need to show transfers of money to him in your taxes to claim him as a "dependent."

Secondly, if you applied for the CR-1 visa, on the DS-230 there is a question that specified you should request a social security number be issued once they arrive. Takes about 6 weeks from entry to US, I believe.

I don't know about other visas.

Tammy, he's not going to be a dependant, he's a spouse and yes you may file jointly, supports not an issue. he needs an ITIN you get by including a w-7 form with your returns, read irs publications 519 and 1915 (especially the 1915) to make sure you do it right and just so you know, when I was getting H's tax id number and filed jointly before he was here, tax prep people had no idea what I was asking them to do so you have to read it and do it yourself or it prob won't get done right. by the way, you cant get the tax number in advance. you are applying for it at the same time as you are filing your taxes.

Don't know anything about the EAD.
