For the I-130, I see this site's instructions read:

3. Copy of the Birth certificate for the US Citizen (front and back) or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship. You may use a copy of your naturalization certificate or certificate of citizenship issued by USCIS.

4. A copy of your marriage certificate (If not in English then again get a translation)

6. Form G325(A) all four copies for both parties.

11. Evidence of a bonafide marriage (see note below for what to include)

Note: Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

For the I-129F, I see:

4. G-325A (all four pages) filled out by the US Citizen signed and dated

6. G-325A (all four pages) filled out by the foreign fiance(e) signed and dated

8. Copy of the Birth certificate for the US Citizen (front and back) or a copy of ALL pages of the US Citizen's passport or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

10. A copy of your marriage certificate (If not in English then again get a translation)

My questions:

1. So, is it necessary to complete the G325(a) twice, once for the I130 and again for the I129F?

2. Is the USCS's birth certificate required for both I130 and I 129F?

3. Is the marriage cert required for both I130 and I129F?

4. Is just a copy of a bank statement of a joint bank account sufficient for proof of a bona fide marriage?

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

Whenever I would get confused with the forms I would check out the example forms here on VJ and they would always help.

I am answering your questions with the intructions you posted as a reference. :)

Yes, treat both forms individually.

2. Is the USCS's birth certificate required for both I130 and I 129F?

Yes.

3. Is the marriage cert required for both I130 and I129F?

Yes.

4. Is just a copy of a bank statement of a joint bank account sufficient for proof of a bona fide marriage?

I'm not sure about this one. Perhaps the Guides will be able to tell you more, or the instructions for the specific form.

It says 1 or more, I wouldn't worry about this one too much. I think your marriage cert and one other thing on their list should be enough. A joint bank account shows 'co-mingling of financial resources' - so I think you are spot on.

There is a Canada board person who got an RFE a couple of weeks ago for this (however - they are K1). They work and live at the same place - so you just never know. They sent in several pieces of proof and still got an RFE. Depends who is looking at it I guess. If you are uncomfortable sending in just 1, you can always send more - good luck!

Take into account the I-130 and the I-129F are completely different visas and each will need the same or similiar documents.

If I were you I'd check into just going with the I-130 [CR-1] and forget about filing the I-129F[K3].

CR-1 [immigrant visa] is a MUCH bettervisa.

K3s [Non-immigrant] Since the fee increase K3s are a pain in the butte now and more expensive plus a LOT more stress and hassle.\

For 'Proof of a Bona Fide Marriage' all I had at the time I filed was our marriage certificate and affidavits from 3 people saying they were at the wedding and that they've seen us as a couple, etc. The more you can provide from that list the better.
