Is getting pregnant while waiting for K1 visa advisable?

I would recommend you wait, figure out things first before bringing a child into an unknown future

I agree. Aside from having an unknown wait time to even get the visa, IF the visa isn't denied, there is still the possibility Heaven forbid, that the situation won't work after you are together in the USA. I have heard of several recent relationships breaking off just before the interview or within a few months after the SO arrives in the USA. Since it doesn't help you get a visa, I'd wait.

DITTO BIGTIME!

Easy to get "knocked up". Not so easy not to!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

My husband and I also wanted to start our family before the visa was issued, but its a really good thing we didnt. I would have spent the entire pregnancy alone and apart from him, gave birth without him, etc. That would have been emotionally unbearable for me. This visa process is already hard enough on the heart strings, and I wouldnt add anything else to the list if I could prevent it. Now Im glad we waited. It didnt take long to get 'a bun in the oven' after he arrived here. And its soooo much nicer when you can share it. Im wishing you the best of luck for a speedy approval and a bundle of joy when you're ready :)

a child of any US citizen has the right to acquire the citizenship of either one of his/her parent.

My child is born in PI and shes now holding US passport.

Just got to prove and show documents of what would the embassy will ask if you want to register your child. :D

... I guess he could come over there while you give birth but then you'd have to apply for the K2 for the baby to enter the states as well and that means more money.

wouldn't the baby be USC citizen as her/his father?

Not if the baby is born in the Philippines :)

Yes it will be ... birth just has to be registered with the US embassy in the Philippines...

If one parent is a US citizen, the child is a citizen too, regardless of where it is born. Out of wedlock would require convincing evidence of paternity, but as long as the child is his, that wouldn't be an issue.

Not that I advise getting pregnant now, but still...

Its not entirely automatic, unless both parents are citizens. But its not too hard to get citizenship for a child born out of the US.

From here: http://www.visalaw.com/05jan1/2jan105.html

Children born abroad to two US citizen parents, one of whom has resided in the US prior to the birth of the child, continue to be US citizens at birth, and need take no special actions to retain citizenship.

Children born to one citizen parent and one foreign national will obtain citizenship at birth if the citizen parent resided in the US for five years before the birth, with two of those years after the age of 14. The child does not need to take any special action to retain US citizenship.

Children born out of wedlock to a US citizen mother will be US citizens if the mother resided in the US for one year prior to the birth of the child. Children born out of wedlock to a US citizen father will acquire US citizenship if the following conditions are met:

* There is an established blood relationship between the father and the child,

* The father was a US citizen at the time of the birth,

* The father has agreed to financially support the child until it is 18, and

* Before the child is 18 it is legitimated, or the father acknowledges paternity in a document signed under oath

While these are general rules, Congress has continually amended and revised many laws relating to citizenship, particularly those dealing with the requirements for retention of citizenship. If a person believes that they have a claim to US citizenship, they should consult with an attorney for a full examination of that possibility.

In the OP's case the child will be an American citizen. The will just need to register the birth abroad - no biggie.

It isn't true that 'a child of any US citizen has the right to acquire the citizenship of either one of his/her parent'. There are certain criteria for residency that must be in place.

Hi,

Well, I agree with most of the replies here. This question seems to come up frequently, and I can't really understand it. What's the rush? Why not wait until you get the visa, get married, and get settled in the US? I know surprises happen and children are always a blessing but why plan it at such an unpredicable time? Regardless of what the estimated process times are, my husband and I are proof that things don't always go on schedule during a K-1 process. We waited almost over a month just for our package to be accepted at the embassy after being sent from the NVC (something btw that shouldn't take near that long). To me, it would seem so sad to be in another country having my fiance's baby and possibly still going through the K-1 process. I know having a baby is a wonderful experience and noone can blame a person for wanting one but waiting, in my opinion, seems much more logical and responsible. As a side note, as it has been said before, pregnancy does not qualify as a valid reason for expediting a case.

great idea!!!!

and when you have visa problems, and it is delayed, and the USC decides to bail, and then the Consulate may decide that he needs some DNA evidence, and you are stuck there with no money, etc. great idea...!!!

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

The OP did not ask for lifestyle counseling with her life choices, she asked a specific question as to whether or not a pregnancy would harm her K-1 petition/interview.

Whether you feel she's making a mistake or not is not what she originally asked!

Correct me if I'm wrong. I would think being denied her petition would harm her petition a bit!!!

who said the USC is bailing?

The OP asked whether it would harm her petition....I'm not so sure myself, though I'd lean towards 'no', but that's just my gut reaction. The OP did not ask what everyone thought of her getting pregnant & whether or not going it alone would be a great idea.

'what are you in a rush for?' 'the relationship might break up once you get here' etc are IMO quite unnecessary & very speculative and forward in the first place. No one here knows her or her fiance, so these type of warnings should probably be left to friends or family.

Hello Everyone,

Happy weekend to all! I've been wanting to post this question days after my fiance confirmed his plan of visiting me again. We haven't seen each other in five looooooonnnnngggggg months and really excited to be together again. Well, now I guess I have to just be direct with my question...

If I get pregnant (with my fiance of course) while waiting for the approval of our I-129F petition, will that situation harm us in a way? I mean, if ever I'll found out that I am pregnant before the schedule of my medical exam, will that situation disqualify me to have my K1 visa approved? Is that acceptable at all? Will it accelerate the approval of the visa or the opposite?

Me and my fiance are very open to the idea of having a baby?

But I'm curious if getting to "that" situation now can harm our process.

Everybody's sound idea will be greatly appreciated.

Thanks.

Dont be thinking that this will get you through your process faster, cos it wont!!!

Besides if you do get pregnant then certain things at the medical exam cant be done until the baby is born (x-ray for example),dont rush this a baby is for life and not for a speedy process ;)

Well, that's your opinion, Lisa. This is a public discussion board, and if she has the right to ask a question then others have the right to respond. ;)

It can be an issue if the CO at interview suspects that the USC is not the father (due to the evidence and timing of visits, etc.). I'm not speculating on this in fact I know some people personally that had this happen to them. The CO put the VISA on hold until he got a letter from the USC fiance confirming that he knew about the pregnancy and still intended to marry her after she entered the US.
