i had a lawyer, and he never said anything about a k3 visa, i only found out about the k3 visa after about a year when i called the ins to find out why my visa was taking so long, i called my lawyer and asked him to do a k3 visa which he acted like he new nothing about but siad he would do it he never did, and i didn;t kow it, so i fired him and did the k3 visa 2 monthes ago,

i have never been aproved or didproved for the marrige visa yet,

even though online it did say 2 differnt times it was ok'd

but come to find out through further investigation it was a mistyake, now they are saying they have sent my marige visa to be further investigated

Have you been following your case on the USCIS website, have they ever sent you a lettering saying that they require more time for name checks?

When you spoke to the congressman's secretary, was this after they made an official inquiry or was she just speculating?

they always tell me that the info on the website is wrong

yes they made a official inquiry

and my case has gone to investigations

they say that is all that they will tell them

and all they tell me is their dooing backround checks and if i don't hear anything from them within 6 monthes feel free to contact them again

the congrasssman lady said that these things can take years

and usually get denied, and you can't do anything till it is officially denied

I have a few questions. It may sound rude but it is to clarify a few questions.

What is your status. Are you a native born american, and if not are you a naturalized citizen, or a legal permanent resident ....

If you are not a native citizen. How did you come to the United States.

Where you married before? And if so, how many times and from where are/ were your spouses?

There is alot that is not clear. Please help to clarify this questions so other people can help you.

my wife is in cambodia her first marriage

i was married once before in 1979 divorced 10 years ago

i'm in redlands ca

my wife is in battabomng cambodia

her family is from the country

i met her through her uncle whow i work with

i have been to cambodia 2 times now

first time i went and got married

2nd time 6 monthes later to see my wife

i talk to her 2 or three times a day

every day

she speaks english pretty well

i had a traditional cambodian marriage

took 2 days

Timeline

This is not that confusing........basically, you're stuck in the USCIS black hole. This is very similar to the_dip_sticks case situation. They also filed an I130 and then an I129f thinking it would move the I130 along..............however it has been well over a year and still no approval notice #2.

I feel really bad for anyone in this situation and I really hope this gets resolved.

How long did you talk to her before you got married? And are this just phone calls or also e-mails, chat logs etc....

And, was your divorced wife an american citizen or from another country? What led to the divorce?

Did you ask your wife if she applied earlier for a visa?

after talking to congressman jerry lewis's secretary today, i'm loosing all hope, this has been a long drawn out affair, i got married on aproximately thanksgiving 2years ago in cambodia, i'm a us citizen 55 years old, twice online it has told me i have been aproved and twice they have told me theres a mistake, i did a k1 visa 2 monthes ago, and recently i have wemt to see congressman jerry lewis in redlands ca, and his imigration lady has informed me that my case has been sent to investigations , and that it could take years to finish , thats her experience and that rarely do they get aproved when they have taken this long,

i just don't know what to do at this point, i had a la lawyer and he jusrt robbed me and did nothing, all the uscis has done now is sent me a letter and sid that their investigating my case and if i don't hear from them in 6 ,monthes feel free to contact them, ,

what about my k1 visa will it get held up too becpuse of the investigation on my marriage visa, if so why did the ins tell me to do the k1 visa?

i hope some one can help or tell me where to go for answewrs thanks

A timeline would really help us help you. I've read the thread and it does seem that your cases are stuck in name check. It could be related to either your past or that of your wife. It's also important to refer to what you filed, by the petition type, instead of the visa type. Only your wife applies for any visa and she does so after the petitions are approved.

Your timeline should show when you filed an I-130 and when you filed the I-129F as well as any other events asked for in the timeline section.

Facts are cheap...knowing how to use them is precious...

1 got married nov 2005

went to congressman last week

whats next ?

when mycambodian friendi worked with if he new any nice cambodian girls that might like a us husband, he said he would check

and about 2 weeks later he brought me a pic of his neice whow was 22 at the time i was 53,

i liked her, and i said i'd like to talk tyo her meet her etc.

we text each other i sent emails and we talked on the phone, regularily she was taking english in school

aboutt 5 monthes later after my passport came i tok a trip to cambodia

, to get married we had already decided to take the plunge, i was therer 4 weeks and we had a traditional cambodian marriage

ever since then i talk to her on the phone 2 to 3 times a day

i haVE since went back to visit her once

i will go back again when she has her interview to do with her

i send her between 4 and 5 hundred dollars every month,

i feel so soory for my wife she has put her whole life on hold for this, she is a country girl

never been in anty trouble never had any boyfriends she works hard, now in her prime she has had to wait all this time

we ove each other and we are married in every since of the word.

i am not going to give up on her the must be something i can do

i have done a i 30 petition and

a i29f petition

i have talked to ins on the phone numerous times, and i have gone to my local off ice a hand full of times

no one will tell me anything, why would they treat a natural born us citizen like thi

my last wife was us born also,

i have never even been outside of the country before

except mexico

i have no fellanies

i haven't even had a ticket in a about 6 years

i pay all my taxes

this is such a bad situation, for everyone

can a lawyer help you think

I am not sure but it seems to me that your are pretty confused about the forms and the types of the visas. You said first you filed for marriage visa after you got married and 2 months ago you filed K3 visa. And now here you are saying first it was I-130 and 2 months ago I-129f. Let me clarify that marriage visa is called K3 and the form is I-130 and fiance visa is called K1 and the form is I-129f. If you don´t tell us what you did when and why, it´s pretty difficult to give you an advice...
