At my K-1 interview they reviewed all my court records and criminal record and he told me even though its on my record 2 of the charges did not count because they were suppended sentences and stay of proceedings.. on my visa it says arrest records reviewed no CIMT.. so my question is should i even mention those on my i-485? I will tell them of my mischief charge.. will they be able see those other two? the question asked have you even been convicted of a CIMT? and since my visa says no.... i get confused..

Tell it like it is. If they pull up something you didn't put in the I-485 you may be in deep "da kine". Even tho it didn't "count".

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I know I shouldn't ask but what kind of charge was it ? and how long ago ? It all depends but they usually don't deny AOS based on small charges or dropped charges, unless it was a violent crime, a drug offense or anything that you'd see on TV including fraud, etc... they call is crimes of moral turpitude, but I think only if those were commited in the US. I am not sure.

My wife has been arrested before in the US and although it was questioned on the interview, it never appeared to have been an objection.

If you already had your visa granted, you should be fine. But do put it on your application, because like someone said above, if it shows up in some background check, you will be automatically labeled: "LIAR" and that's not good.

my concern is that on my visa it says no CIMT but if they look it up it may say there is a petty theft.. but the conuslate officer said it dosent count because it was suspended... also a CBP officer said that sometimes their computer dont recomize that...

Mention them. And when you send in the 485 include the report, and any evidence that shows they are no longer on the record etc. Honesty is the best medicine, as a PP said if its a petty crime they normally do not care.
