DCF in Thailand

Hello,

I've been living my wife in Thailand for the past 8 months. I'm fortunate to have an understanding employer in the states, and to be able to work from anywhere that has an internet connection. Not understanding all my options and after talking to an attorney, we filed an I-130 in the US in July and needless to day it's looking like it's going to take quite a long time. My question is this. Is it possible to stop the processing of the I-130 in the US and to do DCF here in Bangkok? I'm pretty sure it would speed things up a bit and of course there are the other advantages of no AOS.

First check with the consulate in Bangkok to see if you qualify to file DCF, minimum 6 month residency in counselar district is needed, you need to find out how you show foreign residency.

Also if you do go DCF, you need to have maintained Domicile in the USA, and filed IRS returns. These should not be a problem, your job is in the USA, and you work remotely.

If you qualify, you will need to write a letter to withdraw the I-130 petition at USCIS.

Lastly there is no K-3 option for DCF. DCF results in the better CR-1 IMMIGRANT visa, this is preferred over K-3.
