Hello,

Something has just come up regarding my health. I was just diagnosed with Deep Vein Thrombosis and have a blood clot in my leg that could move and be fatal. This medical condition is 30% fatal in cases diagnosed with this medical issue (pulmonary embolism). I was reading in the USCIS website that sometimes they are able to accelerate the processing of an application due to extreme circumstances. My question is does this medical situation of the Deep Vein Thrombosis constitute an extreme emergent situation? I am taking medication for the blood clot, but even if they get this one blood clot taken care of there is still a chance of more blood clots forming.

Anyways we asked our lawyer and he said we could try this procedure but since it's not included in the K-3 visa he'd have to charge us extra for it... when all it takes is a phone call and sending the proofs...

If you have any idea about this situation please let us know, it would be of great help, thank you.

07/18, 23 and 25/08 Physicals

08/30/08 Employment Authorisation (valid for 1 year)

08/30/08 Authorisation for Parole

11/19/08 SSN (valid for work only)

12/04/08 Initial Interview appointment / Rescheduling requested

02/03/09 Interview appointment / very easy, very nice officer, not too many questions, our evidences were enough

02/03/09 Green Card granted for the four of us

02/16/09 Green Cards arrived in the mail

Your lawyer like most lawyers are is just trying to take the most money he can get. I got my interview moved up because im pregnant and all i did was call NVC and tell them my situation all you have to do is send them an email with your case number and atten PI supervisor sue in the subject and explane your situation along with all the medical evedance that you have if your case is still not at NVC and still at USCIS then all you have to do is call and tell them and they will be more then happy to tell you what you have to do. just tell them that you would like to know how you can get your case expidited for medical reasons and they will tell you

4/23/2007-Sent AOS Bill payment overnight (james Shortcuts)

4/24/2007- NVC recived AOS $70 payment

4/30/2007- Recived IV Fee bill

4/30/2007- Payed IV Fee bill $ 380.00

5/01/2007- AOS Generated

5/01/2007- NVC recived IV Fee Bill Payment.

5/07/2007- DS-230 Generated.

5/10/2007- Recived AOS in mail

5/14/2007- Sent AOS Overnight

5/17/2007- Recived DS-230

5/17/2007- Sents DS-230 Overnight Didnt use Shortcut because coversheet changed

5/21/2007- NVC recives DS-230

5/24/2007- Called NVC-RFE for affidavit sent

5/31/2007- Recived RFE in mail

5/31/2007- Responded to RFE

5/31/2007- RFE checklist sent re:DS230 NVC Changed Processing for HAV have to send more documents

6/01/2007- NVC recived my response to RFE.

6/08/2007- Recived Checklist Waiting on Police Certificate can't do anything till that comes.

6/19/2007- Sent Response to RFE.

7/02/2007- Case Complet at NVC waiting for appointment

8/16/2007- Appointment Set.

8/17/2007- Case sent to Havana (Also our 7th month anneversary Good Day! Good Day!)

US Intrest Section In Havana

9/13/2007- Interview in Havana-Visa approved !

9/17/2007- Started Carta Blanca.

10/12/2007- Carta Blanca recived. Went to go buy plan ticket :)

10/17/2007- WELCOME TO MIAMI He's finally here !

I'm sorry to hear about your condition. In your position, I would be terrified to fly anywhere! Will you be able to go by water to the US?

I agree with Miriam that it would be better for you to try it on your own instead of paying the extra fee to your lawyer, especially if it's the same lawyer who has already delayed your journey by several months. Good luck! :)

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

DVT is easily treated... the clot will be broken up and absorbed back into the body... you will have to take warfrin meds to prevent this happening again but you will still be able to fly once the clot is gone just make sure you take the blood thinning meds on time when you fly...

Dont know if it is ground to get your case expedited but you can ask... I know of one couple who were refused expedited service and he had cancer...

No matter what you do to expedite the spouse visa, I suggest you get her here on the VWP or B visa, so you can be together right away.
