Most people file for both but usually the k-3 gets his or he spouse into the USA faster whereas the cr-1 takes time but when they enter they do not have to wait for ssn too long

why would anyone choose the k-3 visa over the CR1

The applicant is coming from Canada, where the CR1 is going to take at least 6 months longer. Or anybody else who finds gaining as few as two months on the timeline is worth the extra money and trouble. There are actually quite a few of both.

Frankly though, I think the reason we have so many in the pipeline now is out of ignorance of the USCIS policy changes.

Facts are cheap...knowing how to use them is precious...

Frankly though, I think the reason we have so many in the pipeline now is out of ignorance of the USCIS policy changes.

You hit the nail on the head! I was going to go for CR1 and use the K3 interview hoping to cut some time off the wait, but USCIS didn't follow their policy.

But I guess in our case, K3 would have made some sense anyway. We've been apart for about 9 months and being back together 2-3 months sooner is worth the extra money. CR1 is a lot cleaner, but really about the same thing as AoS...but the difference is on AoS, we can wait it out together and even if it takes longer than CR1, we don't care, cause we're together.

Wife's visa journey:

03/19/07: Initial mailing of I-129F.

07/07/11: U.S. Citizenship approved and Oath Ceremony!

MIL's visa journey:

07/26/11: Initial mailing of I-130.

05/22/12: Interview passed!

Definitely time. K3 brought us together at least 6 months sooner. In those six months, he was able to get acclimated. With the Cr1, having the immediate ability to work is nice but not if you're entering a different culture and need time to acquaint yourself in the first place.

With the AOS fees as high as they are now, I don't know which one I would choose today. Time apart or money?

You hit the nail on the head! I was going to go for CR1 and use the K3 interview hoping to cut some time off the wait, but USCIS didn't follow their policy.

Simple if the beneficiary is from Canada, Mexico or countries near the US.

Just get the K3 and move to the US and don't adjust status. Depending on the timing. They may have to apply for EAD so they can get a SSN tho.

When the CR interview pops up go back and take it and end up not having to mess and cost with adjusting status.

Not that easy to do for peeps from distant countries.

May be able to pay for the plane flight depending on which country with what it cost to apply for AOS. $1010 to apply for AOS.

Wife is flying to Philippines Saturday. Cost was $900 RT!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

It's about $800 right now for round trip to Ukraine also. We were going to do the CR-1 at the US Embassy in Kyiv, but CSC forced us into doing K3 only. I wish I could sue them for the cost of AOS since they didn't follow their own policies and forced us down this route. I still am suspicious that it's on purpose to milk as much money out of us as they can. Even the whole change where they hold the I-130s and only forward the I-129Fs to the NVC is corrupt I think. They say that this is because most people pursue K3, but you know, it would be very easy to just ask on one of these forms what the petitioner wishes to do. I think it's all designed to siphon as much money out of us as they can.

Because we could not see into the future and the research last December showed a K3 wait being around 6 to 9 months.

You can still wait and and send in the I-129F after NOA1 for I-130.

You can still do both seperate if you don't mention you are going for a K3 when you apply for the I-130.

You can still wait and and send in the I-129F after NOA1 for I-130.

You can still do both seperate if you don't mention you are going for a K3 when you apply for the I-130.

And Pushprk! Please help pass on the correct information on how to keep them both moving. I've seen you post such.

No, sir or madam, sending the petitions in separately will not get them processed separately. They go to the same service center and get married up so they are adjudicated together. I'll post the link again here as I've done several times this week but we really have no reports of success keeping both petitions moving.

I really don't mean to sound too, um, assertive about this but my best guess is this is about the hundredth time I've personally explained this in the last 4 months. I'm hoping some others will finally get the message and carry some of the water on this.
