how long does the fiance can stay in the usa? i know it is 90 days allowed.what happened if the ex-fiance over stayed in the usa? is it allowable if the ex-fiance leave the usa on the 91th day?

What do you mean by allowable? After 90 days you would be considered out of status and would be here illegally. But no one is going to come knocking on your door looking for you.

10-13-05[/color] Called NVC again. FINALLY! They said they received the file on 10-11-2005 and now issued me our case #.

what happened if the visa petitioner and the fiancee called it quits? i know the fiancee can stay til the 90 days is over. are there any circumstances that the fiancee can stay longer in the usa? what happened if the fiancee luckily find a sponsor for working visa?from what i know (i may be wrong) they must exit usa or they can still stay in the usa while processing the new visa.can they wait in here for the visa process?

if the befinciary (the personin the philippines) doesn't marry the petitioner within 90 days of arriving, then the person will have stayed past their visa and cannot apply for another. afterall the person came into the USA on the basis of getting married, not getting a job.

Of all the reading that I've done here and other sites, the sole purpose of the 90 day stay is to get married to the original petitioner. That's it. Nothing else. No more, nothing less. I think overstaying the visa would further complicate matters if the non-USC ever wanted to apply for another visa.

now a days, USCIS is very strict about illegal aliens... just be careful if you plan to be one... i hope you are not using the fiance(e) visa so you can come here faster and easier. forgive me if i'm wrong...

QUITS means there is NO Intent of marriage so yr Finace has to leave before the 90 day period. Also if he stays back USCIS would look at it differently in terms of fraud

more than 90 days is an overstay -- and its not advisable. though one might overlook this is there was some major health crisis or airline crises that prohibited flying-- but any overstay - is a major violation..as far as visas go..

even if the fiance(e) is lucky to find a sponsor for a work visa, they need to go back to home country and await visa processing. If you plan to apply for a work visa, then an overstay is not a good idea as it will come into play when consul makes a decision on the new visa.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

U know what? That's terrible!!!!! Your petitioner just let you come here for what :angry: ? Not sure to marry you and just playin' your feelings :angry: ? I am filipina too and it hurts me that SOME american is irresponsible.

Hope you will be fine and do something not to overstay here or else u will be catch. Don't think of going to be an illegal allien coz..who knows???????? you still get many chance to come here again.

Did I miss something??? Nobody said it was the american citizen's fault... maybe it just didn't work out or something... we don't know what happened, I really don't think we can blame anyone.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

I thought the same thing. I personally dont see that anyone would go through this process without intention to marry. At least not the USC. And before anyone gets upset about that comment, I only meant that the USC has no benefit if there isnt a marriage in going through this since the intent is to live in the US. Were the plans to live in the other country, then maybe it would make sense to conclude that the USC was the one without the intent to marry.
