The Border Protection, Antiterrorism, and Illegal Immigration Control Act (H.R. 4437) would categorize illegal residency in the U.S. as a felony. Democrats inserted the "felony" language in an effort to undermine the bill, said the bill's sponsor, House Judiciary Committee Chairman F. James Sensenbrenner, Jr. Sensenbrenner (R-Wis.) said he and other Republicans wanted to make "unlawful presence" a misdemeanor, not a felony.

I'm OK with felony, but if the Republicans having the majority allowed the Dems to stick something in a bill that they didn't want, they are incompetent boneheads.

In general, a misdemeanor is punishable by a fine and/or up to a year in jail; a felony is punishable by more than a year in prison. (Or, rather, the maximum punishments for felonies is more than a year in prison. It's still possible to get probation or less than a year in prion for a felony.)

Currently illegal entry is a misdemeanor. Re-entry after deportation is a felony.
