Im new and just starting on my I-129F Petition. I know im going to fill the I-864 for support but I read somewhere that even though you make the 125% qualifications on the poverty level, that you may still be denied. I was wondering from anyone who knows of or has had similar experiences, What are the odds of being denied? I read somewhere that they look at the overall picture. for my situation my minimum level of income is 21462.00 I make a little over 24000.00. i am currently in technical college, but am graduating at the latest by June 2008. My past 2 years income tax returns it states i made 29000 last year and 25000 the year prior. Im only 22 years of age and have a son. My work history is excellent and ive been working since i was 15 non stop till last decemeber when i started school. each job ive stayed in for over a year, so i dont know if they take all that into account and whether that information will be helpful or harmful to me. If anyone has any advice that they could spare please give me an opinion. Thank you!

As long as you meet the minimum requirements for the household (I am guessing it would be you and your fiancee and maybe your son also) you are fine. You meet the financial portion of the requirement (you will also need a letter from your employer). There are other things e.g. proof of meeting in the last 2 years etc. that you need to show also. The US consulate (you haven't mentioned which country) will also have local requirements and level of scrutiny that your fiancee (and you) must pass before the visa will be issued. Generally speaking people from so called high fraud countries have a harder time. Good Luck

For the I-129F alone you should be fine. You meet the requirements and that's all the adjudicator is looking for. Depending on what consulate you have to deal with, you may want to get a co-sponsor down the line. You may wish to ask others going through the same consulate when you get to the interview stage, whether or not you should pick up a co-sponsor to help cushion things.

Welcome to the board Romilen. Please note that the form you'll be filling out for the K1 is the I-134. This form is only required when your SO goes for the interview and not when you're filing the petition. The I-864 is used when your SO is adjusting status.

Also, if you're only now starting the process, it's very likely that the poverty guidelines that you'll have to meet is that for the year 2008 and not 2007. Nonetheless, with the figures you stated, I do not foresee you having any problems regarding the 125% requirement.

Worth noting is that if, at the time of filing for Adjustment of Status, you do not meet the income requirement, you can postpone filing for AOS. As long as you get married within 90 days of your fiance(e)'s entry into the US, that's not a problem. Obviously the downside of that is that he/she will not be able to work and you will only be delaying the arrival of the green card. Still, if you cannot meet the income requirement and cannot find a co-sponsor, and if you have a better-paying job somewhere down the line, that's an option.

And like someone else noted, the affidavit you fill out during the K-1 process is the I-134, not the I-864.

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

Thank you, so it is the I-134 first...and thats good to know that i can wait to file the AOS because I do know that I am going to have a better job surrounding the time im hoping all will be approved because i will be finishing school soon and im currently interning for the college where they will assist in myjob placement after graduation. So i am happy to hear that!

Thank you so much everyone, i get so nervous that I will read everything I can find and will then confuse myself, so thank you so much for everyones help and words of assurance. Since I have received responses I have been able to calm down a bit and worry less. So again, thank you everyone So much

Since you have not even begun the I-129F process, the need for the I-134 (if even required) will be 6+ mos. from now at the consulate interview... You have a long time to worry about this document and a long time to correct any issues you are afraid of.
