Hi everyone.

My Fiancee is only 17, and her state requires she have a letter of concent from a parent. Just wondering if someone could just type up an example of what needs to be said on this form and how I should lay it out.

A letter of consent for your fiancee's parents, is her parents' responsibility. I take it she is the petitioner. If she and her family can't figure out how to write such a letter on their own, I would have serious doubts about the validity of your case. The letter is a simple statement that could be as short as a single sentence, plus a date and signature.

Couldn't have said it better myself. Check State requirements and check with Clerk of Court.

I have checked. We require a letter of consent from a parent. As there are example forms on the site of how to write a cover letter and fiance intent letter, i just figured there might be a certain way this letter needed to be worded.

If you are worried at all about what the letter should say, you should consult with an immigration attorney. The price wouldn't be too much for one to aid in the drafting of a letter, and that way you'd know it was spot on. I used an immigration attorney throughout our entire immigration process and I found him to be most helpful and kept me from getting any RFEs. Good luck!

Hi, yes she is the petitioner. The reason I ask is because I know that everything has to be just right with the application and I don't want to delay it by missing something obvious. I kind of thought it was a silly question, but I always like to double check.

The only reason i am doing this form is because I am printing everything out. I will obviously get it signed by her parents before sending.

Unfortunately, you're making your relationship sound like you're arranging for a wife. The process is intended to be one where the USC petitioner makes arrangements for their fiance(e) to apply for a K1 visa, so they can marry in the US. As such, she and her parents take the lead. Your need to draft a letter of consent for a 17 year old's parents furthers this impression. The letter should be in their words, giving their permission for their daughter to marry you. It's pretty darn simple. The local requirements aren't part of the petition process. Her parents can deal with that if she still needs it by the time you arrive and are ready for a wedding.

That doesn't entail that he's writing it on behalf of the parents any more than someone following the guides here is arranging for a spouse because they got to see the sample letter of intent, or that someone asking for a sample of an answer for Q18 is planning to lie about how they met. If you ask how your partner should conduct herself at the consulate, are you arranging for a wife because it's 'her' visa, not yours at that point? Come on.

It's their petition. They're taking ownership of it rather than just guessing what supporting materials to need. I'd be more worried if it were the parents doing the research.

Anyhow, to the OP. There isn't a special form or anything that you fill out for USCIS for permission to marry. Her parents just need to write a letter indicating that they give their consent if I'm reading 5C correctly. I am not an expert, but were it my petition, I would ask my parents to note:

-their relationship to me

-that they give their consent for me to marry

-and that they intend to follow through on whatever legal requirements there are in our jurisdiction.

I would also have it notarized to show that it was my parents signing the permission form, not me.

Once you're here, you'll have to do whatever the county you marry in requires you to do if she's still underage.

One thing to keep in mind -- if she's not yet 18, she can't serve as a sponsor for you, so you will need to have a co-sponsor (like her parents) lined up.

Thank you to everyone for thier feedback and especially the ones who helped, you know who you are. This is a big thing and its great we have the ability to help each other out like this.

My fiance, Luke was the one speaking in the posts and after reading the feedback I'd like to say thank you for it all. It will be very helpful. Luke and I want everything to be done and sent properly. As of the concent issue I understand that my parents should be the ones writing it but as she is sitting next to me now, no one is left in the dark in this situation. Luke is extremely helpful with the process and I am very thankful for that. He's a darling.

Luke, here is your answer in all its glory. The instructions for the I-129f (assuming you are planning on getting married in the USA) are very clear on this point. The instructions are the first 6 pages of the downloadable form from the USCIS website. It would make things easier for all of us if the next time you ask a question, please provide us with ALL the pertinent info if you want an accurate answer. We had to assume who was the petitioner, where the marriage was to take place and what type of visa you were pursuing.

I am going to give you some advice here and I hope you take it to heart. You are asking a question that was easily answered by reading the instructions. This is only the first of many long and complicated forms you will be required to fill out. I strongly suggest you consider an attorney or find someone who is experienced in matters such as this. If you fail to follow the instructions perfectly you can find yourself, and your fiancee suffering very long delays and it could cost you a lot of money. I do not mean to sound harsh but this is a reality of this process. Ask any of us that have gone through it or are in the process.

1) The first part of your question deals with who may file. There is no age requirement listed in the "who may file" section. That answers that. The local age limit for marriage dictates this aspect of your questions. (see #2)

2) The next question is: What are the requirements of the USCIS as far as proof of eligibility to marry? See what is highlighted in red.

3) The last question is: What must a letter of consent say? That is entirely under the jurisdiction of the State in which you are going to be married, assuming you are getting married in the USA. That is a State issue and the County Clerk of Court in your State will have all of that information.

1. Who May File?

You may file this petition if:

A. You are a U.S. citizen, and

B. You and your fianc?) intend to marry within 90 days of your fianc?) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:

(1) The requirement to meet your fianc?) in person would violate strict and long-established customs of your or your fianc?)'s foreign culture or social practice; or

(2) It is established that the requirement to personally meet your fianc?) would result in extreme hardship to you.

B. Provide original statements from you and your fianc?) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent; and

C. If either of you is of an age that requires special consent or permission for you to marry in the jurisdiction where your marriage will occur, give proof of that consent or permission; and

D. If either you or your fiance(e) were married before, give copies of documents showing that each prior marriage was legally terminated.

One more point...

I think it very likely, depending on Deanna's birthdate, that she will be 18 by the time the visa is issued and you are allowed to enter the USA on the K1. That will negate the letter of consent but it will still be required by USCIS for this part of the process.
