Filing for AOS LATE!!! Need advice desperately!

Hi folks.

There's NO DOUBT what a colossal problem I (we) are now faced with. My (Russian) wife and I WERE married w/in the 90 day K-1 required window, but for various reasons (some of them unforseeable and unavoidable, some of them B.S.- please don't ask :blush: ) we are just now preparing to file for AOS. Info presented on the USCIS site regarding what problems this presents and how to deal with these problems is near to none. Nevertheless, I have gleaned that my wife and step-daughter are likely considered "out-of-status" at this point. Has someone else 'round here made this same fatal error? How did you proceed?

This really needs to be stickied.

It's not a fatal error. They won't even care. Just file it. Being out of status is forgiven at AOS through marriage to a USC.

aos timeline:

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

As a K1 visa holder the only rule you have to follow is that you get married within the 90 days after arrivel.... there is no rule about when you need to file for AOS... there are some people on here who have waited more than a year to file for AOS... you just need to file as soon as you can... one thing to remember is that the medical your wife had done is only valid for 12 months, so if it is more than 12 months since it was done and you have yet to file, she and the child will need to have the medical redone by a civil surgeon here in the US...

Dont stress yourself too much you have not made any fatal error....

I could point you to a recent thread I saw here where the poster was saying how they waited for nearly a year after getting married to file for AOS, just because they were lazy. They didn't have any problem. It's recommended to file for AOS as soon as possible after marriage but it's not a requirement. Don't worry about anything and just file whenever you're ready!

Timeline:

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

Not filing AOS limits the beneficiary's ability to enjoy the LPR status. It isn't a crime to not file AOS for a while.

You were married within the 90 days of your arrival into the US. You've fulfilled it and give yourself a well deserved pat on the back. Just make sure you follow the guides here to fill your AOS.

N-400 for Citizenship.

09/15/2010 Application Sent.

09/22/2010 Check Cashed.

09/23/2010 NOA Sent.

09/27/2010 NOA Received.

10/15/2010 Biometric Appointment.

01/26/2011 Interview Letter.

02/24/2011 Interview Date. PASSED!!!!!!!!

03/25/2011 Received oath ceremony letter

04/21/2011 Oath Ceremony @ 12:30PM

Oath Ceremony Completed. Now A US Citizenship.

I-130 Petition for Mother

05/05/2011 Application Sent To Chicago Lockbox.

05/11/2011 Check Cashed.

05/14/2011 Received NOA.

08/03/2011 RFE Notice Sent.

08/06/2011 RFE Received.

08/22/2011 Send Additional Evidence.

08/25/2011 Status Update Changed To RFE Received.

09/02/2011 Approval Notice Sent.

09/06/2011 Approval Letter Received.

09/29/2011 Received Email With NVC Number, Fee, And Choice Of Agent Form.

09/29/2011 Paid NVC $88.00 Fee Online.

09/30/2011 Online Status Changed To Paid.

10/07/2011 Emailed Choice Of Agent Form.

10/12/2011 Paid $404.00 IV Fee Online.

10/14/2011 Online Status Changed To Paid.

01/10/2012 Email From NVC Stating Case Complete And Interview Date 02/16/2012 @ 7AM

01/18/2012 Medical Appointment

02/16/2012 Interview Date PASSED!!!!!!!!!!!!!!!!

You're fine. We had to wait to file AOS, too. As long as you got married within 90 days, you're fine. The biggest downside to postponing AOS is having to wait longer for work auth.
