After the National office completes initial processing your case will be referred to your local CIS office where you will be interviewed for your permanent residency or be transferred to CSC. Prior to this the national office will send you communications requesting biometrics be taken and schedule an interview with you for this. 15. The time estimates under the K1 flowchart are a little "off". One would think the POE could potentially take longer than obtaining a SSN.

22. Interview appointment for AOS. When approved you will MAY receive an I-551 stamp in your passport indicating you have been approved for AOS and will also receive your green card in the mail later.

IF your forms include an I-485 AND an I-485A, forget the "A" one...it is used for other types of applications

for adjustment, such as assylum asylum...you ONLY need to file the regular I-485 Form, not the A supplement.

Even if you received an EAD (work authorization) stamp at the port of entry, you STILL need to file the

I-765 for the actual EAD card, as the stamp is only good for the first 90 days!! BE SURE TO USE CODE ©(9)

FOR A 1-YEAR EAD CARD when filing concurrently with I-485.

No, there was no requirement for a divorce or death certificate.

I'd like to help out with the updating of the guide but won't be able to take a look at it until the end of the week. However, I really would like the I-693A information to be made clear since there is so much confusion over it. Here is a link to the information which should be covered. I'm also wondering if we should include the info for the civil surgeon who does the form for $10 by fax.

"If you are applying as the spouse of that person, alsoattach a copy of your marriage certificate and copies ofdocuments showing the legal termination of all othermarriages by you and your spouse;"

Seems to indicate that they are needed.

Those instructions don't apply to K-1 or K-3 visa holders. Not terribly familiar with it but I believe it's for people who are applying because their parent or spouse once held legal resident status. Not sure how that works.

Just read better. Section was titled, "Based on derivative status as the spouse or childof another adjustment applicant or persongranted permanent residence based on issuanceof an immigrant visa.". This is refering to people filing for AOS on the basis of derivitive status of another person who entered on an immigrant visa who has a pending AOS / granted perm residence.

There are often questions abnout the member missing the NOA2. Perhaps a little blurb on how to obtain the NOA2 if missing/lost.

Suggestion:

Should this document be misplaced/lost/never received you can file an I-824 for the cost of $340.00 to receive a duplicate copy via mail. Perhaps we could also add in the K1 Visa tips HERE: To be careful with this document as it will be needed for AOS in the future.

Question.

Are the guides good for anything? I've encountered nothing but problems following these "guides". I sent my wife's divorce paper from her previous marriage because the guide said so. May I suggest taking the "guides" down if they're going to do nothing more than "guide" us to misinformation? Thanks.

when I filed for the K-1 I needed to send in the death certificate of my first husband since he passed away while we were married and I had to send in a copy of the divorce papers for my fiance from his first marriage - that was to prove that both he and I were able to marry. For the both of us it was each our second marriage.

I am sure that most people would agree that everyone should fully research the process and and if they have any doubts to contact a a professional for assitance. Going to Aila.org you can find terrific well qualified professionals in your area. Also since the guides are "general" in nature they may mention items or things that do not apply to all situations so please keep that in mind. As time passes the requirements may change. As noted about the guides and member supported and in this threads case an item was no longer needed to be sent in (but does not hurt if it was). If you spot any areas of improvement in the guides feel free to suggest them and if the community agrees we will add them!

CE, thanks for your answer but I was referring to the AOS from a K1 visa, guide. It's a fairly narrow category, and it is where I got my information from. Also, I sent you a private message a few weeks ago asking about why I can't edit my posts. Did you miss it?
