What are the chances if I am HIV+

To the OP, there was a case of a USC married to a Russion woman which was eventually approved. I read about it in another immigration forum. They were both HIV+, though, don't know if this makes any difference.

Health insurance (or the lack thereof) will be the biggest hurdle to overcome, IMO.

I can't imagine being able to walk one inch on your shoes right now, but just know that the medicine right now is so advanced that you will be able to live a normal life. I have a friend who used to date this girl and she is HIV+, but my friend is negative, he never got the disease (protected sex though), anyway, we met the girl in NYC this summer and she has been HIV+ for about 5 yrs and she looks as healthy as anyone HIV- and happy, very happy - she had just gotten a job at a broadway show. So don't let it beat you down, the worst thing right now is for you to allow any type of negative thoughts, we know it is hard but you will be fine.

Look, I am not sure where you are from, but someone brought up a really good point, life would be financially-speaking a LOT harder if you stay in the US, I am saying this, b/c I dont know you might be rich or have good insurance - who knows, but the point is, it would be good to look into it, I know Brazil for instance provides drugs to HIV+ patients for FREE, and I know many countries offer the same...so it would be good for you to find out, if you don't already know and maybe consider going home. If that's not an option, get a lawyer and go get advice from him, we can offer help here, but we are not in the position to say 100% what you should do, especially in such a delicate process.

I am so sorry for all of this, but stay strong, it will pass and you will be happy again soon.

I am so sorry for such terrible news. However, it isn't all hopeless after all. There are processes that allow you to attain a waiver. If you are already in the United States and adjusting, you can do it from here.

EDIT: It isn't the end... you still have a chance to adjust, and according to the article, spouses of US Citizens can file the waiver. Best of luck.

I am taking it positively since it is already spilt milk which I can not recollect.

It is the hardest thing I have had to deal with in my life...but I forge ahead with hope and high anticipation that something works out..

Section 212(a) of the Immigration and Nationality Act reads:

First of all, I am very sorry. I hope that you dont feel your life is over, there are drugs that can keep you alive for a long time. Just look at Magic Johnson.

Secondly if you can afford a lawyer, get one! You can get approved.

The biggest issue is, who will pay for your care? The government is more worried about that than any health threat.

Prayers will be sent your way. DO NOT GIVE UP!

Am very positive person by nature but this is a massive blow and at a time when I thought I was acheiving one of my dreams.Anyhow since the results, I am adjusting to the facts ,though hard but I know I will be OK with time.

After a second test which will be a confirmation of the first test, I will go ahed and identify a lawyer to seek further advice,then proceed from there.

Currently I have a good insurance under my hubby's plan, which I acquired before the tests( not that I ever thought I was infected).

Am all full of hope and praying for a miracle...

Eligibility to file a waivers for HIV+ aliens (those deemed inadmissble under INA 212(a)(1)(A)(1)) is possible under very limited circumstances

One condition is that you are the spouse of a USC

I hope that I could qualify for the slim chance...

He is a USC, very supportive and wants to be, till the end..

First of all I'm sorry about your news. This is devastating news for you but it isn't the route to the end of your life. There are so many new drugs on the market now that keep HIV+ patients healthy for far longer than even five years ago. Many live full and healthy live with a decent drug regimen.

Secondly, I agree with the others here that you will need a waiver of sorts. Plus I think you also have to consider your medical treatment over here in the States. HIV+ drugs are expensive and I doubt that you would be eligible for healthcare insurance as it is now a pre-existing condition (unless you were covered before the diagnosis).

I'm not sure where your home country is but you are more likely to get decent health coverage there than in the States (specifically cost wise). I think that these matters are more important that the AOS process at the moment. Don't forget that your spouse will also need an HIV test at some point too (probably 2, one now and another in 3-6 months time).

Could you move back to your home country with your spouse (if she/he is HIV-)?

I am from TZ in Africa.Only God knows because I have lived a normal moral life and here I am...Its hard but I will learn to live with it.Currently I have a good open insurance cover but probably might change as the sickness gets to a serious point...I will know all about this when I visit a HIV specialist this Friday.Once I get the info then it will be much easier for me to make a decision medical wise.

Yes, my spouse will also be taking a test this week...

I have no problem going back to my home country,this might be the end resort. If I can not adjust my status there would be no point livingin the US idly and worse as an illegal.That would kill me faster.. I just need to make early plans..

Anyway I shall be crossing that bridge when other avenues become inaccesible....
