Timeline

Waiting like this is entirely against my nature. Yesterday my husband using infopass scheduled his appointment at our local USCIS office for Thursday 10.11. at 11.45. He will be requesting some further explanations.

It is not about using tricks to obtain our approval sooner than everyone else. That is not our intention and except for senator’s involvement it is impossible anyway.

Just like the rest of us (VJ users at least) we feel like puppets while USCIS is pulling the strings. And doesn’t matter we understand backlog etc.

It is about us making a statement, letting them know that present situation is unbearable.

:lol: …. just realized how pompous is what I've written. Don’t take me wrong. I just feel that it has to be done something even it is only bugging…

I wish you all the best! The process is pretty lenghty and is very difficult to be seperated from your family. But, anyway good luck to you.

Further explanations on how after 3 mos. you don't have an approval for a process that is publicly being reported as taking 6 mos.?

I understand you perfectly.

it's very difficult to just have no choice but to wait for whatever times they set for the process... the fact that it's all in their hands, and nobody else is looking at it, and they have nobody to report to for production/efficience is just frustrating.

The funny thing is that nobody NOBODY knows about what we're going through. Every american I talk to about my marriage asks me " but why aren't you living with him?" "so you can't get right in, you're married to him #######"

I think we need tell people about the absurdness of this situation at ever chance we get, so USCIS starts to feel a popular pressure to be more efficient.

Timeline estimated adjudication on March 4, 2008. It was adjudicated on April 23.

Our I-130 was approved in 258 days.

Timeline estimated adjudication on April 4, 2008. It was adjudicated on April 23.

Our I-129f was approved in 197 days.

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

I think it's also noteworthy that we who choose to go about this in the legal manner are waiting so long and treated rather poorly. And this after paying nice fat fees along with our taxes.

Good Luck, but I don't think you will get anywhere. This is my prediction of the response your husband will get

"Your case is still within our processing times".

It took them 10 months to approve our I-129 and my husband already had security clearance with the DND.

Our I-130 was sent back to the CSC from the NVC on and received on Aug 17 yet it still took them six weeks to acknowledge they have it, even though they have no idea why since they have no record of asking for it back- or the approval being revoked or our application being under AR.

We we told they would try to let us know within a week as to why the hell they have the I-130 again in the first place.

There is no K3 category on the official USCIS page; they only reports K1, K2 – NOT YET MARRIED, states clearly. My husband called already USCIS, and they’ve told him (getting rid of him), to go to the nearest local office for further explanations. OK. So he scheduled an appointment for the further explanations. For USCIS every single detail is important, and has to be accurate with their requirements. So if there is no reported category I want to know the reasons.

Their own regulation: (from September 2001)

Timely Processing of K3 Applicants

25. The LIFE Act created the K3 and the V categories to bypass administrative processing delays that cause long separation of families. K3s are immediate relatives of U.S. citizens. Posts should keep in mind that the intent of the K3 is speedy reunification of U.S. citizen families.

VJ brings me almost all information needed and I also think it will be “Your case is still within our processing times”, but no matter

I’m from the other side of barricade means - I’m the beneficiary so I feel even more powerless. At my husband work everyone are asking why I’m not already with him and no one believes in this long administrative process, not to mention that I’m only in half on the way.

BTW: CSS is seeking for experienced attorneys, probably because they are increasing staff anyway and among them attorneys as well, probably but maybe there are more inpatient people - this me being demagogic :)

I wish you luck in your meeting. I'm guessing it won't accomplish a whole lot, but the more times individuals raise a fuss about their case, the more the USCIS people get tired of hearing it; thus, the more they would want to hire additional help....at least you would think and hope that would be the case ;) Maybe you don't end up making a whole lot of difference for your case's timeline, but your individual effort may help other couples in the future :yes:

Anyway, the further along in the process you get, the better you feel. I thought the process would never end but now I'm only two weeks away from heading down to Lima, Peru to be with my wife and go to the interview :thumbs: Every day that passes is one that USCIS can't make you wait over again. You'll get there!!!

In order to use the above in a contextual arguement you need to understand the processing times of I-130's in the years before its enactment. Since in recent times the I-130's are indicating 6 mos., the K-3 is fast approaching extinction.

First, thank you for sharing your thoughts fwaguy.

I’ve tracked USCIS processing times for two years. I agree that now, to approve I - 130 is 6 m only, then 3 at NVC and Embassy (that vary in Poland is 1-3 m). During this process I can’t apply for other visas because the pending immigrant petition.

Still the 12 months waiting in my opinion is unacceptable and K3 should serve as a remedy. Unfortunately it doesn’t (especially now when waiting for the NOA2 hike to 5 months).

I also understand that ours arguments are nothing, really, yet I do feel that taking any action my help if not us maybe someone’s in the future.

This is maybe idealistic but looking back into history assures me that mainly those are making changes.

We should question everything that can be questioned. Only then we will find things, that cannot be questioned.

This is simply not true... I am aware of a few people who had pending I-130's who subsequently (or interimly) applied for a tourist visa and it was granted.... Is it more difficult? probably... but it is not impossible or prohibited.

Maybe this question off the topic at hand but can someone please try to explain me why there is SOOO of much discrepancy within the K category visa itself, per se, especially for the recent NOA2 coming out of CSC.

I did some K1 vs. K3 timeline search/comparison and here is what I found according to VJ timeline seach function, assuming I did my search correctly:

1) Total K1 NOA2: 25 for the dates of 09/30/07 thru 10/12/07 @ CSC.

Total K3 NOA2: 2 for the dates of 09/30/07 thru 10/12/07 @ CSC.

2) Total K1 NOA2 between 09/30 thru 10/12: 8 for NOA1 05/31/07 thru 07/01/07(K1 filers who filed in June @ CSC)

Total K3 NOA2 between 09/30 thru 10/12: 0 for NOA1 05/31/07 thru 07/01/07(K3 filers who filed in June @ CSC)

So, if I infer these data properly, CSC has already started to approve June K1 filers whereas thru April K3 filer's thread I know that most of the April/May K3 filers at CSC are still waiting and for the life of me, I cant understand why there is so much of discrepancy within the so-called "K" category visas. Isn't K3 is to married couples what K1 is to unmarried couples? Furthermore, USCIS doesn't even report K3 tracking publicaly anymore on their website. Does that mean they have indefinite time to adjudicate K3 petitions?

To avoid any misunderstanding, its not my intention to knock off any K1 filers. I know this is not their fault or is in their hands anyways. As a matter of fact I am whole heartedly happy for them for their NOA2 but its just that I would like to see some progress/processing in K3 category too? Why this much of a bias towards one versus another?

Sorry for the rant and vent but I had to do it today. It gets little tiring and heartbreaking after seeing so much of these.
