Does being disabled and not working be a cause for denial? I receive Social Security income of 15,125 yearly but Hawaii 125% poverty level is 19,688. My lawyer advises to use assets of25,000 bank account. Even then will just barely make required income level, so my brother-in-law,(same household,more than adequate income will co-sponsor). I live with my parentsand do not pay rent,food etc. Will a letter from them help? Also have seen posts stating that USEM, does and does not accept co-sponsors for K-1 visas.What is true? Anyone know of an approval when Petitioner is disabled and not working? Any help appreciated. Also my diability is permanent.

Being disabled is not a reason for denial as long as the income is sufficient and will meet the 125% poverty guidelines. In your case, you can use your brother as joint sponsor if he's making more than enough. I've heard it too that USEM is not accepting co-sponsor for K1 but I have seen some cases who used one and didn't have any problems. Just provide whatever documents you can show to prove that you can support your fiancee once she's here in US.

Thank-You Mae for reply, but I'm worried about not employed. I-134 tips guide says if petitioner is not working (on welfare) or other GOVT. BENIFITS or has no plans to work actively, the petition can be denied. Ihope that SSD is not GOVT. BENIFITS>

Thank-You for your reply! Just worried about Petitioner not employed after reading Capt. Ewok's I-134 AOS tips. Hope that GOVT. BENIFITS are not cosidered welfare.

The purpose of the 125% of poverty level is to keep beneficiary off of welfare. SSI and SSD are not welfare.
