What is our status while AOS pending?

Hi everyone,

Just had a small question (probably dumb I know). After getting married from a K-1 visa and filing the AOS paperwork what is my husband's "status" in the US? The reason I'm asking is we were trying to get his learners permit to learn how to drive last week and it got a little complicated when they were trying to validate what his immigration status was (wanting to see the marriage license, taking copies of my information, and ect.). He was able to get it but it just got me thinking what is his status now? It seems like it's sort of in a crack so to speak.

November 18, 2005 - Visa in hand! (Day 184)

December 19th - Vipul arrives in US

March 22, 2006 - Applied for AOS, EAD, and AP

June 6, 2006 - AP approved

June 9, 2006 - EAD approved

Feb. 5, 2007 - Becomes permanent resident

Dec. 9, 2008 - Filed I-751 to remove conditions

February 2009 - Conditions Removed - Next step Naturalization

November 19, 2009 - Filed for Naturalization!

It seems like many people have their own opinions on this, but i've never actually seen an official response (on the USCIS website for instance) :huh:

I'd like to know where people actually found out their information from - everything seems to be heresay on this issue :whistle:. K1 adjusting to xx, adjusting, k1 visa holder adjusting. What rules and regulations is the person supposed to follow during AOS. The limits set out by the original visa, a mixture of this and "AOS rules" or a whole new set of rules for AOS?

Anyone have something official - a link, scan, CNN, court case etc? :help:

I don't know why it is so important to hang a name on this. If you came in as a K1 and married within 90 days then your status is " legal " based on the fact that you are married to a USC. You file the AOS, which is pending and you wait for your status to be adjusted to some sort of permanent resident ( depending on the length of marriage ). When you get the EAD you become " work authorized ".

I don't think it is important to the USCIS. That is why they haven't made a name except "legal". You don't become "illegal" until you get one of those letters telling you that you have 30 days to leave the country and you ignore it.

29 June visa granted

Sometime in July Lucero came to US

13 Sept 05 Married

1 Nov 05 -USCIS recieved 485 and EAD

13 December RFE stupid things I should have included Returned very quickly

27 March received bio letter for New Orleans

7 Apr_06 Bio done in New Orleans

20 April 06 Touched on all applications

21 April Email received EAD approved

27 Apr Received EAD card

30 May 2006 Received appointment letter for JaX on 13 July 2006

13 July Interview successful approved

20 July Received green card

30 June 08 Sent I751 to remove conditions

25 July 08 Application returned erroneously incorrect fee

27 July mailed new application with separate checks

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

17 Sept Mailed 3rd application with mountains of proof of error copied Senator Mel Martinez

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

I always described it as "adjusting status to permanent resident".

However, that being said, I didn't have the same issues here in WA that I've read (on here) a lot of people elsewhere had with getting a driver's license and other paperwork. Might be due to the proximity to Canada and the amount of cross-border migration in this area, but that's just a guess.

I'm glad Vipul was able to get it. :)

When I went to the SSA office to have my name changed in the system, the guy there told me my status is "AOS pending".

That said, I do agree that there are different terms out there, or at least that there is not one official term that every agency would use. So it's just more confusion...as always :D

AOS timeline:

03/17/06 filed for AOS

03/28-06 touched

04/04/06 biometrics

04/05/06 touched

05/23/06 transfered to CSC

06/17/06 touched

08/16/06 touched

11/20/06 USCIS cust.service started inquiry about case (because it's outside of processing times)

11/30/06 approval e-mail

12/07/06 Greencard in the mail (= 8 months and 21 days for the entire AOS process)

They ask your status on the AOS forms as I'm sure you know(since you filed them, DUH! me! ;) ) and I always just called it by what we were told to write there.. Adjustment Applicant as Swirly said. I'm sure any of the above would work, but that's what we always used. M.
