The K-Visas are NON-Immigrant visas at the consulates are required to use I-134 for non-immigrant visas.

The I-864 is used for GREEN-Cards. Either for CR-1/IR-1 Immigrant visas or when a NON-Immigrant adjusts status in the USA when filing I-485.

You can use your gross annual income for the I-134, if your personal income falls below 125% povertyline, most consulates will let you use a co-sponsor, but your co-sponsor will then need to have income that exceeds 125% povertyline.

You can use assets to make up a short fall, but assets are only valued at 1/3 of income, that is if income is 1000 below the line you will need to show 3000 in assets.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

I am self employed but i didnt make i was going to use my household income to make up for household of 8 including all ppl on tax returns and persons in household but i thought it was like I864 where it gives u the option to note it on form but i do not see this anywhere on that I 134 form. i dont have pay stubs as i am self employed anywa i guess i will deal with this later, but i need to know from now with my household income i am way over but not with mine alone for a total of 4 ppl total.including on my taxes and including my husband and self , because there was 1 year that i didnt work soo....

Use a co-sponsor that has no dependents, and who makes over 125% povertyline when counting just the co-sponsor, and prospective immigrant the K-3.

One other thing, consider carefully the K-3, as you can see this is just one of the hassles this visa can give you. K-3 is more expensive, has the pain of adjustment of status in the USA ($1010), has to wait up to 90 days for an EAD to work, more paperwork.

Compare the K-3 and CR-1 timelines. For most countries the K-3 is only slightly faster to get.

The CR-1 uses the I-864, and you can have the help of other household members, they can provide I-864A forms to help get you up to the poverty line.

You are right i see this now i think the total time save may be 5 mos or so i guess i need to make more planned trips and let my hbby get cr1. the k3 does not ask u anything about using household income etc. I think i might stick to cr1 and just wait.hes in africa and dont even mention flight cost wooow. oh well i just sent my k3 in. im wondering also when will i get an approval sent I 130 on 6/28/07 i guess ill see what ahppens by this month.its kinda scary this process because everything is left in their hands ...thanks for looking out u keep reinforcing the cr1 rte you should know youve been there right?. i think i may take your advice its a hassle
