Timeline

I'm contemplating moving back to my home country - India since the visa bottleneck seems to be going nowhere and also loosing hope in this whole retarded process. What is the outcome of leaving the process at where ti stands and picking it up from India? Would that affect the processing of this stupid case?

I do have 1040 from previous years and also W2 for this year to back up my earnings(assuming interview sometime in 2008).

any insights and reflections would be greatly appreciated.

I definitely would explore my options to return or to stay back(more favorably) if I do decide to go back to India.

My question mainly centers around the aspect that I have paid the fees and taxes till date so would like to get the adjudication as an option.

I respect the long wait of many members on this forum but since I do want to get practical in life events.

I'm not sure of the CR1 visa process (we did K1) but I think that you need to be present in USA to continue to pay the fees and submit documents in a timely manner (unless you have a lawyer to do it). Otherwise, if you just stop the process at this stage and move back to India, I would think that the case will be considered abandoned and it will end there (you will lose whatever fees you paid so far and will NOT be able to continue the case where you left off; if you decide to again apply for the visa in the future, you will have to start from the beginning).

However, if you are happy to move to India, you can remain there indefinitely and if you wish to relocate to USA in the future, you can read up about DCF (Direct Consulate Filing), Delhi allows it. Then you can remain together in India during the visa process, and go to USA together. I believe there is a time constraint though, I think you (as the USC) need to be living in India for a certain amount of time before you can file for DCF (6 months or 2 years or something).

Again, I am not familiar with the CR1 process so the above are just my thoughts. Good luck for whatever you decide! :thumbs:

All fees are paid and non refundable. If you want to stop the process of immigration, then you should notify the NVC that you want to terminate your petition.

OR

You could continue with your petition and just take a month away from work to visit home and "connect" with loved ones.

I would suggest this as compared to quiting your job and having to be re-employed later.

If the beneficiary should later elect to consular process instead of applying for adjustment of status, Form I-824, Application for Action on an Approved Application or Petition, must be filed with the USCIS office that approved Form I-130. Upon favorable action on Form I-824, USCIS will send Form I-130 to the NVC.

I would add the caution that we have only one report of success in getting the I-130 moving with an I-824 and it took about 8 months. One is also still pending after even longer. The fee is $340.

This policy is only relatively new. 11 months.

can you let me know what's the option to make sure the I130 is used in case both are approved, is there an option to make sure I130 gets used?

THE PROCESS IS CALLED DHC ..DIRECT CONSULAR FILING... I HAVE FRIENDS WHO CAME TO U.S W/N 5 MONTHS OF MARRIAGE. IT USED TO BE 60 DAYS ... NOW YOU AVE TO PROVE THAT YOU ARE A TEMP INDIAN RESIDENT TO QUALIFY FOR DHC ... IF I HAD MORE THAT 120 DAYS TO SPEND IT INDIA THAT IS THE ONLY ROUTE I WILL TAKE
