When is the soonest practical date to file AOS for someone with a K1? I think that's what I want to do when the time comes.

You could get married the day the beneficiary arrives and then would be able to file for AOS once you have the necessary documents. For us it took about two weeks to get the marriage certificate from the county recorder's office.

Every state is different, but most require that you have proof that you are in the country legally, and for an extended period. The K1 I-94 usually is not considered proof of legal residency because it expires in 90 days.

You may also be required to have an SSN to apply for a driver's lisence, and if you wait too long to apply for that, the SSA won't give it to you. Go as soon as possible to apply for the SSN. Like, the day after you arrive! If you wait til your I-194 is almost expired, they will just send you home. IIRC, the I-94 still has to be valid at least 2 or 3 weeks.

Hi Mary,

We wanted a summer wedding on the Detroit River (appropriate, yes?), and well, thanks MTL...I'm not waiting until NEXT summer SOOOO.....

Doug's i'view is 11/8 and I booked us flights to St. Pete Beach, FL for 11/18, we're marrying on the beach on 11/20!!

As for the AOS, I'm planning to get all the paperwork done b4 we leave so I can send it in ASAP when we get the marriage cert! :thumbs:

Well I talked to my fiancee and we're both still up in the air about a set date now. We're going to see what happens at the interview. I wanted to buy plane tickets like a month ago, but my future mother-in-law told me just to wait until after the interview. Which makes sense. Guess I need to have that reassurance that I've been approved before I go spending money on plane tickets that are non re-fundable. So the day after my interview, I'm getting our tickets. As far as a honeymoon, we don't know what we're doing about that either.

Honestly, I'd try to get married before January. That way your fiance will get a nice income tax refund, since he's been witholding as single for most of the year, but he'll be able to file as married.

here in Maryland you can just transfer your drivers over... as long s your i-94 is still valid..

ALSO...

in our county you have to have a SSN to get a marriage license. So check into that right away.

I thin kMonday is our day at the court house.. we wanted to go a couple days ago but our son came 4 days early..

In Georgia you will need either your AOS or your EAD to apply for a Driver's License. You will also need your Social Security number, so make sure you apply for that about 2 weeks after you arrive here regardless of when you are getting married. You will enjoy winter in Georgia - especially after Toronto!

In Washington, you also only have to transfer a German license with proof of valid I-94. Would it be impossible for you to get a Canadian license, Mary? Or would it even be worth it?

It wouldnt be impossible for me to get my license here, but my interview is in a week and I'm hoping to move within 2 weeks after that, so theres no point in getting my drivers license now. Plus, its a lot more money to get it here, than it is in the USA.

I understand about the whole drivers license thing - I've lived in a city with great public transportation ( 20 min max bus ride to work and not crowded!) and now I'm going to live in suburbia. Beautiful neighbourhood, but just ridiculously impossible to even walk to the 'Kiss and Ride' location.

Sooo...eventually I will be learning to drive and with 3 months off roughly, I'll practice a much as I can while waiting for the EAD to kick in.

About the wedding date....we just had our interview last week and waited to book anything until afterwards. I feel safe enough now that they've said it was approved and I can see the package on Canada Post's website tracking.

We started giving folks an approximate date once we knew the interview date and decided on Sat, Nov 24. Thus far we've booked the honeymoon cabin, finished up the wedding decoration details, started working on vows and booked the UHAUL. Also gave 3 weeks notice at work and then I'll have 1½ weeks to pack and chill out at home

Nov 11 - get UHAUL and pack it up

Nov 13 - teary goodbye & moving day

Nov 24 - morning wedding & brunch then...the HONEYMOON...finally can relax!

Sadly, not as many Canadian guests can come as we would have hoped, but we can't let that stop our plans. We want to be married and have waited long enough in our opinion....we want to get stuff filed prior to Christmas...even though things may sit in limbo for a week or 2 around the holidays.

As soon as I clear customs, he'll be throwing my luggage in the car before we race to the nearest courthouse. I'll get married in the clothes I flew in on, all bedraggled hair and creepy airplane smell, red-eyed and b*tchy and cramp-legg'd, and we'll file for AOS before the USPS closes for the day. ;)

Romantic, huh?

In a few years we'll get married with hoopla, but this is strictly a paperwork-focused timeline/choice. We're calling the quickie courthouse marriage our 'ceremony of cohabitation' a la one of the VJ posters on here. :devil:
