Hello friends.

We just sent the I-129F today. Now it's time to wait and wait

My husband and I have been discussing details and possibilities, and we were wondering if having a prenup might make USCIS think that we don't have a genuine marriage.

We got married here in Brazil after 6 months of living together here. We have evidences of a 2 years old relationship. According to brazilian civil law, we married with complete separation of possessions.

We have some financial links between us, which we sent evidence of with the I-130: He transfered about 4 thousand american dollars to my account, which I used to pay upfront for our 6 monts of apartment rent (I sent all receipts and statements, also the lease contract); also, he had an acute apendicitis on january and had to have emergency surgery here in brazil, for which I took full responsability, I signed all his internation papers and left my dad's safety checks with the hospital and the surgic team, later I signed the payment contract and the promissory notes for the full payment of 17 thousand american dollars (I sent all that documentation as well, and I have evidence that I am helping him pay for this hospital expense).

Chris was going to open a joint account for the two of us, but apparently, after the patriot act it is a lot more difficult, and I would have to be there in the US to open the account with him, which is impossible at the moment

So, from your experience in this process, my dear VJ friends, do you think that my financial comitment with my husband is enough, or do you think we might have complications because of our prenup?

You should present evidence at the time of interview as requested. You don't have to show more than what you want, if you don't want to disclose that information, then don't bring it up during interview. It's very common to see couples signe prenup agreements before they get married though and you have plenty of evidence to you that you have a bonafide marriage.

Well, our very marriage certificate states we have a prenup, so we wont be able to hide the fact from them... we can only hope they just read it quickly and it goes unseen...

Im pretty sure that during the interview I can convice the consul of the integrity of my marriage, I am worried right now about getting an RFE or something

Well prenups aren't exactly unheard of in the US... I think they may ask you during the interview why you chose to have a prenup, but I don't think it'll be a huge hassle

It seems to me that the reason you have the prenup is more to do with Brazilian law than with a personal decision, so I really cannot see it being a problem at all even if the question is raised. Even if it were purely a personal decision, I don't see how they could fairly judge you two on that as plenty of American couples rountinely get pre-nups.
