We are wanting to be careful in the way we do things. We will soon be entering the US with a K3 visa. I am the USC and husband is K3 visa holder. We are wondering if my husband begins to send out resumes while he is in the AOS/EAD process if that would jepordize anything. He doesn't intend to actually work, but just wants to begin the looking process.

2007-Nov-21: Mailed AOS/EAD

2007-Nov-29: AOS/EAD received

2007-Dec-4: Notice date

2007-Dec-11: Received NOA's via snail mail

2007-Dec-12:Received Biometrics appt

2007-Dec-21: Biometrics appt completed and USCIS "touched" applications

2008-Jan-24: EAD card ordered - received email notice from CRIS

2008-Feb-1 : EAD approval notice mailed- received email notice

2008-Feb-4 : EAD card received in mail (11 days from when it was ordered)

2008-Mar-16: Touch on I-129F - huh?

2008-May 2: Received Interview date via snail mail letter

2008-June 11: Interview at SF office - Approved!!! Green Card ordered

2008-June 23: received Green Card in mail

My husband started applying for jobs before he got his work authorization. We choose to do this because the entire application process (submission to interview to offer) can take a while, and depending on your industry/profession the wait can be several months. We just wanted to get the ball rolling and would not have accepted work until the EAD arrived (we don't want problems and we didn't want to cause any for a potential employer). My hubby is still looking for a job, but now he can accept since he's got his EAD. We were K1s so we had to wait. As, a K3 won't he immediately be able to work since he'll enter with a green card?

K3 does not mean a Green Card!

Its actually worse than K-1, no temporary EAD, and no ability to get a SSN, despite already being married to the USC....

My wife started looking, and has had to turn down two positions because we still don't have the EAD....

So, timing is everything!

But, in answer to the original question, it is totally legal.

I-130 to Nebraska

It's perfectly fine to look for a job before you're authorized for work, and there is no way USCIS would know anyway. It's not like they're reading your mail (snail and electronic) and following you!

Didn't Bush just sign into action a law this year, allowing snooping into the mail and electronic mail of foreign citizens in the US though?

I know they don't bother reading the mail now, but later on, oh brave new world...
