You would probably be better off going to Canada to get married - then you don't have the stress of him possibly being turned back at the border (although it apparently doesn't seem to be a problem).

Hopefully he will make a full recovery soon, however if he does require some time off work to recover there are programs in place for that and while things might be tight - it won't be the end of the world.

Sometimes you just have to do what you have to do.

I know. I'm just really, really scared about the time frame we may have to do this. I don't know all the details of how bad things are with his health. I just know it's not good. sigh.

I got married in the ISA and then went back to canada to start the process

Did I tell the POE officer that was my plan? NOPE!! Did he as, NOPE!! Only answer what they ask, but be honest!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Sorry to hear that (F)

Though I either must be missing something or I dunno. Why wouldn´t your fiance go to the interview in November? Is that cuz of the medical condition doesn´t allow it? Cuz if you are at the end of K1 visa journey and you switch to K3 journey instead, the new process will take you so much longer now. People who are getting K3 now have to wait a really long time for everything to go through. Why don´t you get K1 visa in November and get married with that and then you can both be together in USA or Canada?

Believe me I WANT him to do the interview. However, he still has NOT done his medical yet. Big, long story all to due with his health and a misunderstanding he had about having to have the interview letter. It's just a huge mess. You wouldn't even begin to believe the horrible 'luck' he/we have had this year.

A few months ago I had spoken with two different attorneys who said that if we get married in the states and eventually want to bring him here, then he can easily be denied because he came over for the intent to marry and of course our laws don't allow that.

The only reason I'd even consider us just making a day trip to Buffalo to get married would be so that we can immediately start paperwork for me to go to Canada and live. However, if a miracle happens and he eventually overcomes this, we might want to move to the U.S. at some point. I don't want that one choice to totally screw our chances of bringing him here some day.

At the same time, his illness may be so bad that he never gets better. Everything is so up in the air and I'm terrified...again. This time though, things seem much, much worse.

I don't know what to do.

After going through all that, my question is this: Have any of you married in The States, had your spouse go back to Canada, then were approved on the spousal visa to the U.S. without a problem? :(

I remeber you Lyric and wandering how you are doing!....In this situation, as anyothers who want to be together and get married, nobody has the right to intervene in that moment. It's nobody's business in my opinion. I also think that the most important now is his health and whatever makes him happy to heal the fastest possible. So, things have to be taken day by day, and so on, each moment to be filled with joy !!!!...Good luck and keep us updated!!!

Note: were told the long delay due to huge backlog and internal changes in VT

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.

I still hope you can work things out somehow and go for the interview cuz your situation must be complicated enough by now so if there is this chance to do this one thing in November that would help you be together then I wish it will work out for you guys :thumbs:

I remember that you had looked into immigrating to Canada when your fiance originally became sick and I'm so sorry that you are back in the same situation. Did you contact anyone regarding coming to Canada and being able to work while your adjusting status for humanitarian reasons?

11/19/07- EAD approved online and received same day (actual approval 11/07/07) :)

So sorry, Lyric. I wanted to jump in here since I know a little bit about Canadian immigration. I have not gone through it yet, but have been researching it.

First, if you get married in Ontario, the license is fairly quick but the certificate takes 90 days to process, then you have to apply to have a copy sent to you (another week). We got married in the courthouse and this time frame *IS* true. Yes, it is ridiculous.

The rest of this is from my readings:

If you cross to Canada with your Marriage Certificate (I feel like something else would work, but I don't know, I think there is some way around the 3 month for a MC thing) (I meant that I think you can cross, get married and stay), the border patrol will give you 6 months temporary residency. You may not work, however during this time you should apply for PR, and after you get your initial approval, you may work. The approval SHOULD take about 3-4 months.

*OR*

You can get married and apply for Canadian PR from the States. This will be a shorter wait time for your intial approval, because unlike the US, Canada wants to reunite families.

Canada is full of red tape too, but it is a lot easier to deal with.

You can start the Canadian immigration part without getting married. Canada allows conjugal partner sponsorship, you don't have to be married for him to sponsor you and for you to apply for a visa or residency. Check with these folks, they may have some answers for you http://www.canadavisa.com/

It sounds like you're really stressed Lyric, and you've been at this awhile I know. I'm so sorry things still haven't turned around for you guys. Big HUGS to you.

I really don't have anything to add to this thread other than opinions and speculation, however I note your signature says your interview is November the 1st. It's only the 10th of October. Is there no possibility that he can have the physical now?

Please look into this. If he has the medical, you could still attend the interview and then this would be moot.

The only problem with that is I don't believe Canadian Immigration will really allow or permit Conjugal Partner sponsorship for heterosexual couples. I know I'm paraphrasing here, but I tend to recall Zyggy stating that he once warned a heterosexual couple against doing such a thing (they didn't listen to him) and Canada turned the couple down.

I realize there could be numerous reasons for rejecting sponsorship, so the fact that a couple is heterosexual or homosexual may or may not have anything to do with it. However, Zyggy might know a little more than most of us about this sort of thing.

Once again, I'm not sure of all the details, but I do remember him saying something to that effect. I'd definitely learn a little more about it before "putting all of my eggs" into Conjugal Partner sponsorship (or any other sponsorship position, for that matter).

As my wife and I were beginning the CR-1 process, we got married in Windsor, Ontario, and we had the license and certificate very quickly. We got passed waiting for the documents by driving to Toronto and requesting them in person. It cost a few hundred dollars for the expedition request, but within a week my wife had the documents arrive in the mail :) Good luck and sorry to hear about all the problems!

Last year I had spoken with someone about speeding up the entire process due to humanitarian reasons. However, not the possibility of being able to work. I never thought of that part. As far as the speeding up part in general, she said just because he has cancer, even though it's a life threatening illness, that it can't be sped up. They use humanitarian reasons for people who are in war torn countries etc. So if you're spouse/spouse to be is dying.....too bad for you, basically.

This is definitely true, and to be honest the humanitarian process in Canada isn't all that quick either. It took my wife's family 3 years almost to the month to get approved, but they could work through that entire time. For that entire time, however, they could've been denied at any time and ordered removed, so I'm not quite sure that'd be a way you'd want to try either.

They went through a program in the United States called Freedom House. I believe it's just for asylum cases, but you might want to check into it as they were insanely helpful.
