Timeline

Thank you all for the wishes and support it does the heart good to see what is written and by who.

I'm hoping that something good comes from my action that will help others in the same or similar situation in the future; being that making a notation in one’s file that jeopardizes the complete process without having any proof of the assumption and that the noted assumption is false and proved within the medical report and presently in hand documentation and on top of that having a second CO state that the previous CO’s assumption in their view was not correct as they could not detect what the first CO noted that they did.

I am hoping that my action will cause a change that will make it necessary for a second CO to confirm the first’s belief as that is not the present case and nor was it in our case. I am not disputing the fact that I had a criminal record and on that alone I would have done the I-601, I never denied have a past drinking problem and on that I would have done an RFE willingly. I have proof documented proof of the fact that I had a criminal record, that documentation was presented in its entirety, I don’t deny that I had a drinking problem, I admitted to that and also stated how long ago I gave it up. My medical stated and confirmed that I was alcohol free yet I doubt that was taken into consideration or the medical results even consulted as it should have because of the CO's assumption, all the information presented should have been taken into consideration regardless of what the CO thought.

What I do not like is as per my thinking the CO’s written comment in my file was taken for gold when in fact it was lead and that a new analysis of the matter y another CO would have proven that. The CO’s written assumption influenced/tainted the decision making process and brought on the I-601 which in again my opinion would not have come into consideration because of the time gone by.

I have no idea of what will happen regarding what I sent to Washington I do hope that it falls on someone’s desk that will take a good look at it and actually read through what is there and then ask Montreal for the files they have and see what was said to place us in this situation. I am hoping that further correspondence with them will be positive and if a second interview is scheduled it is without prejudice and fair for all concerned.

3. I get barred for life for fear that I will get drunk steal their car.

4. I get invited to lunch with the Director in Washington.

Any bets on which one I get?

I'm not sure what will happen - but I hope you get the lunch invitation!!

I think we deserve lunch and Debbie should be the one paying for it and it should nothing but filet mignon. IF we get an invitation we'll ask if a few friends can come along and bring each on of you with us. Cross you fingers on that one if you want o join in.

Oct 1/09 - I-751 package sent

Oct 5 - NOA mailed

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Dec 2009 - Received 10 year permanent resident card.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.

Thanks Lynette, I read your last post and am really sorry that it didn't turn out as it should have, Canadian family get-to-gethers usually last until the host boots everyone out. I wish more family attended your wedding also or at least replied to what you took the time to send them. The world is turning into a very sad state of affaires.

I really should have just rolled over and done the waiver thing as they want but this is one Canadian that just has to see what would happen if. In this case if I sent to whole danmed thing to the biggest person available (the director). Only four things can happen:

I'm not so sure I can agree with your lovely evaluation of me but I do know that Sharon agrees whole heartedly with you because I read to her what is written about us and she can't beleive that others see in my writing what she herself sees in me. It is nice to be thought of as a good guy.

You are so right about this. What is the point of presenting evidence at all if the above is the case? You do your due dilligence and jump through all the hoops and provide all of the documentation you have worked hard at getting and THEN someone behind a bullet proof pane decides it isn't true or misinterprests the information?

Absolutely in cases such as this a second or third CO's opinion should be sought. Anyway, I admire you taking this on and attempting to make a difference.

I'm hoping that the news I can bring here after hearing from Washington is good and could be helpful to others that feel they were mistreated at their respective consulates.
