CSC said they shipped my entire petition back to me on October 2, but I've yet to receive it. (I live in San Francisco, so hopefully it will arrive today, although CSC says it may take up to 30 days)

Inside the package, they'll list the reasons behind the rejection. If it's something small, like a missing check box, I wish they would given me a courtesy call instead of wasting 2 months worth of wait.

I'll be sure to update my timeline once I get the package.

Sorry for the ranting, but I do appreciate your input and thoughts.

Yes, I went through the copies, and there might be 2 issues that could be cause for the return...

1. my lawyer said only 1 page of the G325A was needed, not 4

Based on guideline for k1 visa: http://www.visajourney.com/forums/index.ph...mp;page=k1guide

G-325A (all four pages) filled out by the US Citizen signed and dated

G-325A (all four pages) filled out by the foreign fiance(e) signed and dated

-------

CR1-CR2

06/22/07 - Sent I-130

12/04/07 - Approved

06/26/08 - Interview

07/04/08 - Visa on hand

08/08/08 - Arrived in US

08/21/08 - SSN and GC in mail

Removing Conditions

06/15/10 - Mailed I-751 packet via USPS

06/17/10 - Delivered to CSC

06/22/10 - Check was cashed

06/24/10 - Received NOA letter (Dated 6/17/10)

07/03/10 - Received biometric letter (Biometric Appointment dated 07/23/10)

The mail room makes a quality check on the petition when they receive it to make sure that it is a valid submittal.

They look at things like:

correct payment,

signed and dated petition with original signatures

etc.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

yes, the most likely suspect is you are missing 3 signed and dated G325a pages for you and your fiance. that will have them send it back to you for refiling. i would be screaming at my attorney for my money back if he told you , you only needed one copy. He has cost you 6 weeks you cant get back. I am pretty sure they also sent you payment back as well since they kicked it back this early. so at least you didnt lose your payment. ive seen on here where the whole package was sent back if check was missing, not signed, if I129F wasnt signed etc.

The G-325a seems the most likely cause of the reasons you listed, but I'm amazed that it didn't just generate an RFE. As others have suggested, are you sure it wasn't something like forgetting to sign your check, or maybe even the check bounced? It just seems like an outright rejection would be something much more fundamental.

they wouldnt generate a RFE in the mail room. they only generate a RFE once it has been assigned someone and they are working on it. The mail room has a checklist they go from to see if the petition has everything it needs to be put into the system. if it doesnt, they return it. If you dont put in your check or forget to sign the check or sign the I-129f they just return the whole thing. Not including all the signed government forms will get it returned. some people even get it returned to them in a USCIS folder with arco holes and everything. thier original packet torn apart. but its still returned. the ones that are good get a number and are filed in a box to be assigned months later. Guess its their way of not getting petitions mixed up in the process that need something.

Maybe they cash the checks and give a number to the ones that are an easy fix, like missing a signature etc. but it seems if they are rejecting your petition and you have to file with a new date why do they keep your money? i had heard of people getting the check back with the petition on here but not anyone getting their petition rejected but the money kept. that seems lame. If they give you a number and cash your check they should give you a RFE and let you keep you filing date. USCIS makes no sense.
