"case rejected" from an August filier (CSC)

Hi,

I am an August filier under the CSC.

I received my NOA1 on October 1, but right off the bat, I got bad news.

After I checked my status online, to my dismay, it said...

"Current Status: Case Rejected

On October 2, 2007, we determined that this I129F PETITION FOR FIANCE(E) was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case."

I followed the guidelines here on VJ, and even had my lawyer look through my petition once I finished putting it together.

I spoke with USCIS this morning, and they said, it can take up to 30 days for me to receive my package. Once I resubmit it , I'll be given a new receipt date, rendering my initial August 22 date useless.

I've lost 6 weeks right off the bat. Had this been an RFE, I would have retained my original receipt date, but that's not the case.

Sorry for the rants, but I'm just feeling really down right now.

10/17/2007 - submitted I-129F to CSC

10/19/2007 - NOA1

03/05/2008 - NOA2

03/15/2008 - letter from NVC saying they will forward to GUZ

05/10/2008 - fiancee receives P3

05/12/2008 - P3 returned to GUZ via EMS

05/14/2008 - P3 delivered and signed for

05/22/2008 - per DOS, eligible for interview

07/01/2008 - interview date set for 7:15am

07/01/2008 - PINK!

07/03/2008 - picked up visa

12/02/2008 - banquet in Shanghai

AOS timeline

12/05/2008 - SFO - POE

12/31/2008 - applied for SSN number

01/08/2009 - married

01/12/2009 - SSN card arrived

02/21/2009 - I-485, I-131, I-765 sent to Chicago box

02/23/2009 - AOS package received in Chicago

03/02/2009 - check cashed

03/21/2009 - biometrics appt

05/26/2009 - AP document approved

06/01/2009 - EAD received

07/23/2009 - AOS interview (almost approved pending receipt of

certified marriage license

07/24/2009 - certified marriage license sent back to USCIS

07/31/2009 - production of Green Card ordered

08/05/2009 - welcome letter received in the mail

I'm really sorry that this has happened to you :(

All you can really do at this point is wait until it gets returned to you and see what they have given as the reason.

Don't be down though! Just re-file ASAP! Hopefully things will start to speed up again soon :D

Damn, sorry to hear that. :(

Hopefully you made exact copies of your original packet. While you're waiting, go back through it and try to sleuth out why they might have rejected it. If you do figure it out, make whatever corrections you need to make and get your new packet ready. As soon as you get the notice from USCIS, verify that you've made all the corrections you need to make and get the new packet out the door.

Honestly I don't understand why they can't make this information available electronically. Would save everyone a lot of time and anguish.

Yes, I went through the copies, and there might be 2 issues that could be cause for the return...

1. my lawyer said only 1 page of the G325A was needed, not 4.

2. there's a section where they ask if you've been in the military, I put N/A.

But at this point, it's all speculation. I wont' know exactly the rationale behind the rejection until my packet arrives.

It's just difficult to swallow to lose those 6 weeks of precious time.

Yes, I went through the checklist numerous times. I thought I was pretty ####### about doublechecking and triple checking my work. Even had my lawyer look through it.

I guess it just shows, anything can happen.

I am so sorry. I can't imagine what you must be going through right now. I think there are words of wisdom though on this board...by the time you refile, things may well be caught up sufficiently that you're not as far behind as you think.

Well, I agree with you on that. :thumbs: I'm sorry to hear about your case. The best thing to do is to review what you have sent them, (and I hope you have made copies of what you have sent them too) and wait for what USCIS may point out as errors on your application.

It's very odd that you received an NOA 1 and then it was rejected. Normally it is rejected before an NOA is generated. It will be interesting to see what the rejection is for.

Day Six: Far too dark in Mines of Moria to brush hair properly. Am very afraid I am developing a tangle.

Day 35: Boromir dead. Very messy death, most unnecessary. Did get kissed by Aragorn as he expired. Does a guy have to get shot full of arrows around here to get any action? Boromir definitely not prettier than me. Cannot understand it. Am feeling a pout coming on.

Frodo off to Mordor with Sam. Tiny little men caring about each other, rather cute really.

Am quite sure Gimli fancies me. So unfair. He is waist height, so can see advantages there, but chunky braids and big helmet most off-putting. Foresee dark times ahead, very dark times.

EAD Approval was NOT updated online. We had an infopass meeting for 3/6 and then the EAD shows up in the mail on 3/5!!!! cancelled appointment,

all i have to say is #######.

I guess those could be reasons, but those kind of mistakes could still be taken care of with an RFE I would think...

absolutely make sure it isn't actually their mistake, and if it is... CALL RANT RAVE :angry: and get your case expedited for their stupidity.

We filed I129F at the end of June,it been rejected

in August and at the end of september our petition

arrived from uscis..

P.S.Will uscis give us a new case number or it will be the same,but case

staus will be changed???

Oct.25 2007 NOA1 receipt .

March 04 2008 Approval notice sent .

It's quite possible that both of these options were the cause for this rejection. Though, I'm nearly certain the G-325a is the real reason. It really does suck that they can't give you a courtesy call or something, telling you briefly what the problem is and how to fix it. For that large fee, you'd think that would be a reasonable service request. A quick little 3 minute phonecall could save sooo much time. It would have taken you one day to print 4 new copies, sign them and send them in. Sometimes, I want to punch USCIS in the nuts! Good luck to you and try to remain calm. I know it's tough.
