My Step-Daughters came to the USA under K-2 visas. My fiancée, now my wife under a K-1. Right after we got married, I filed for AOS and also filed for Employment Authorization Cards. I need the cards for my Step-Daughters who are 8 and 10 because I am retired Navy and in order for the VA to recognize them as my dependents they must have social security numbers. (The only way to get them social security numbers before they have a green card is to get an employment authorization card) I also need them to have social security numbers because of the military health system.

I paid the fee and submitted the paperwork. The form was returned because they wanted their signatures on the form. (Keep in mind they are 8 and 10). I resubmitted and I received a notice some time later that the post office returned the cards to USCIS as undeliverable. I fought with the post office and called USCIS numerous times and really went through a lot of hardship trying to get these cards.

The cards arrived on about 01 October 07 with an expiration of 23 September 07.

Valid from 01 September to 23 September with a Category Code of A06.

I called USCIS and went through the typical bs and was told that I need to do new I-765’s and resubmit the original cards, and copies of the original forms and papers related to this issue.

I was also told if it is found that the reason for the error is my mistake that I will have to pay the fee again. Of course this time it will be the new higher fee with no credit from the last fee I paid.

The process could take 3 or more months.

They have their interview for permanent residency on 13 November and I am thinking of not trying to fix this problem because if the residency is approved on 13 November, they will no longer need employment authorization cards to get a social security number.

Wondering what you guys would do?

There is something seriously wrong with the system. All common sense has been tossed out the window.

I seem to remember someone else complaining about this on VJ once. You might want to search for a similar thread. Unless I'm mistaken, the OP had submitted under the wrong code. There is a A06 and another code, maybe a A08 or 9? You might want to check it out. In this case, it was the OP's mistake for checking the wrong box on what kind of card he was applying for.

The interview is so close, in my opinion, and that's what you're kind of asking for....I'd forgo sending in the paperwork until your interview.

In my case, I had my interview, was given a I-155 stamp at the interview (for travel in case I needed it I guess), and received my GC in the mail about 6 days after the interview. They said it could take up to 30 days for the card.

Just my 2 cents. You won't need EAD if you get the GC's soon. Personally I'd wait. See what others have to say.

I would wait for the interview and see if they can get the I-551 one stamp at that point.

You got an expiration of september "07"? Goodness gracious! I had my AOS for my daughter returned once because they wanted a signature also, my daughter is 11 years old.

Your interview is coming up soon, it's hard to know what to do, whether you wait another month and chance that you get approved or spend that terribly expensive fee.

If I could afford to wait another month for the interview I would do it.

Also, it's a bit weird to think of how the system requires children to have employment cards just to get a SSN. Weird. That is something that needs to be looked at, I don't believe it's the fair option just to get an SSN.

a(6) would have been the reason you received protracted expiration dates. This option uses the i-94 date as the expiration date. If you selected this, then yes, you would have to pay for a new application should you choose to refile.

Your option would be to wait until the interview (a month away) and 90 days for re-application adjudication? I would go for the interview. If for some reason their files are not fully-adjudicated, I would get those EAD applications in the mail at that time.

Don't worry too much and just wait for the interview. Refiling is a waste of money in my opinion. Good Luck

The correct class code is ©(9) ... I just had an infopass appointment this morning .. one issue was that I signed for my 9 year old son under part 5 instead of where it had applicants signature .. they had told me that it was going to be sent back but low and behold they cashed all of the checks .. they are processing his application.

The second issue was that I put (a)(6) in confusion .. They just cashed the checks October 4th (they received 08/01/07) and I wanted to see if they could make the change for me at my local office. They told me that they couldn't and now to wait to see what they send me??? With the code (a) (6) my EAD will expire when my I94 expires on October 24th. What a friggin waste .. they shouldn't even have that option as it's just a money grab.

When I inquired about obtaining an SSN number for my son when I applied for my own (for school and bank account).. they told me that I could go to the Internal Revenue office to acquire one for those purposes (which to date I have not done)

I just spoke with the National Customer Service Center and they have sent a request for the EAD code (a)(6) to be changed to ©(9) ... she told me that the local office would not have been able to do that and that the request has now been forwarded to the correct service center. If I have not received an update with 45 days she told me to call back. (she also changed my first name to the correct spelling) ... here's crossing my fingers!!!!

If I were in your situation I would inquire right away with the Internal Revenue office as per my instructions by my local SSN office here in Cleveland ... otherwise I wouldn't bother refiling if your appointment is in November.

The wait time for an ITIN is 4-6 weeks but can take longer, so they're probably better off just waiting until the interview and then applying for the ITIN if they aren't approved because you cannot have an SSN and an ITIN and the overlap would cause a bit of a hassle for the OP.
