Holding L1B visa, Planning to marry in the US and apply for AOS, help required

Hey guys,

I am currently working in the US on a L1-B visa. I am planning to marry my girlfriend who is an US citizen. We are planning our wedding here in the US.

I have some questions regarding this.

1) Since L1-B is a non immigrant visa can I apply for an AOS through marriage.

2) After getting my EAD, if I quit my current job will I need to go back to my country since my L1-B becomes invalid.

3) Can I continue to work with my employer after I get the EAD until I get a new job.

4) When will my AOS become invalid in the event of my employer terminating my job/L1B visa.

5) In the URL

it mentions AOS for L1 visas. Can the same rules be applied in my case as well (L1 visa marrying US citizen within US and then applying for AOS).

1. yes unless your visa has a homestay condition on it, sorry I just dont know what a L1 visa is or does but if you have to spend time at home you might want to check with a immigration attorney.

2. no once you apply for AOS your status becomes "pending adjustment of status". If you leave the country without either the GC or advance parole you will have deemed to abandoned your AOS application.

3. yes

4. it wont become invalid

5. yes

The requirement for AOS states the following

"non immigrant crewmen are not elligible to apply for AOS.

1) Who exactly are classified as nonimmigrant crewmen.

2) What exactly is a homestay condition on a visa. This was mentioned in the reply above by "Kim and James".

PS.

L1B visa - refers to a specialised work visa stating that I am specialised to do a job which cannot be done by anyone else here in United States. This is a non immigrant visa.

1. some cruise ship workers and those just stopping in ports for a limited time etc, I believe.

2. some visas have a condition where you have to return to your home country for a certain amount of time. If it does not say this on your visa you should be right to adjust but perhaps a consultation with a immigration attorney just to make sure would be helpful but if your case is an easy one then just follow the posted guide.
