Friend Flagged and Denied Entry (Toronto)

Timeline

My friend does a lot of business in the US and sometimes makes trips back and forth. About 3 months ago he was going to Florida and informed the border agent that he was going for a week trip on business. The guard denied him entry, and flagged his profile. He tried to go down last week and they denied him stating that he needs a visa to visit for work (b-1) which SHOULD be assigned WITH THAT guard, correct? At least it always has been for me.

What can he do to visit the US? Should he go to the consulate?

Did he get denied for lack of proof of ties? Did his planned business trip violate the terms of a B-1? He can try contacting his local consulate but many of them do not provide advice on B-1 or B-2 visas (they just process them). Is he a Canadian citizen or a Canadian PR?

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

He is a Canadian Citizen. He was probably denied for not having ties strong enough. First time he was denied (and flagged) was because they didn't believe he was going to leave the US (even though he has a wife and kids and a house and car etc)

I feel for your buddy. I've been flagged myself and still been allowed in after. You really are at their mercy these days. You could bring a filing cabinet but half the time they don't even look at it. If he can get a business visa then, hopefully, they'll let him in. It's still up to the border jerks. I think that they're really afraid of Canadians. Good luck to your friend, I hope he gets into East Germany...er...I mean the US. :(

Ah gotcha. Yeah, he should bring loads of evidence then and make sure the CBP knows that he's not receiving any renumeration from his U.S. business colleagues. It's always up to the individual officer but the more proof of ties he brings the better. I am not sure if the consulate would issue him a B-1 as he is a Canadian citizen, but it wouldn't hurt to try to apply for one as well as the proof of ties the next time he crosses.
