You guys have no idea how much the support means! I was telling dh about you all and had him read some of the posts. I told him about links that have been posted. He said "wow, these people are awesome!" So, thank you to all of you who are helping me try to figure all of this out and for just the support. It really means a lot.

trailmix-As always, great advice! Thanks! I actually faxed the courthouse yesterday about getting his court records. She told me it would be 6-8 weeks :o I told her the situation and asked her if she could have them done sooner. She said she would definitely do what she could. Now I guess the big thing is finding out if we need a waiver. We're going to start making some phone calls to check about that.

IR5-Thank you so much for the encouraging words!! And thanks for all of those contact numbers. Is that where I would call to find Immigration lawyers? Or do I need to look elsewhere for that?

And if we do find out he needs a waiver (which I'm soooooo hoping and praying isn't the case) do they do that right there at the interview? I know that's when we'd turn it in, but does it take more processing before we'd find out? Or would they tell us right there if it was approved?

2-26-2008 heard back from Montreal via email about our interview date

4-23-2008 Montreal Interview!!! Visa APPROVED!!

5-31-2008 Crossed the border into the US to live! :) (one of the happiest days!!)

Currently residing in NC and loving it!

03/2011 Looking into getting dh US citizenship (and just when I thought we were done with all the paperwork! Ha!

The numbers I gave were for the court records offices, but it sounds like you already have them. Six to eight weeks to bring the files from archives is about average for serious charges. The immigration lawyers can be found in your local white pages (in a pinch) but since I don't know which state you plan to live in I can't give you any leads. However, since immigration is a federal matter, it doesn't matter where the immigration lawyer is, there were some 800 numbers to contact lawyers that I used to have (call went through from Canada) but I don't know where I placed them.. I have seen some immigration lawyers advertise free consultations online, on tv and even on craigslist and if you contact a few with specific questions you can usually get quite a bit of info. Once we know more about the charges we can try to formulate a game plan. Even if you think about retaining a lawyer, he or she will want a copy of the court records. The I-601 waiver varies by consulate but in MTL you will be told at the interview or so I've been told (it may have changed since 1998 but I doubt it). Please let us know what the court records shows when you receive it.

BTW, If you don't mind a quick question, but how old was DH when he was charged or at least when he was convicted? I know you mentioned that he was hassled every day after school and from the picture he looks to be 30-35 yo.

I'm so excited! The lady from the courthouse called yesterday and said she had our info ready! I am so grateful that she stepped up for us and got it done. She must have put us at the front of the pack, because she got it done in 2 days. :D So, we're going Friday morning to pick it up. I'll post as soon as I get it!

IR5-Dh was 19 at the time of conviction. And you're good, he is 34 :thumbs:
