Hi Everyone,

I am about to file and AOS application for my wife.. she is currently here on a K-1 we got our marriage certificate last week.. I have two questions before I file!

1> Do I need to have a SS# before I file? Can I file the AOS and then apply for SS# or should I wait to get the SS# and then file the AOS?

2> What name do I file the AOS under? The her maiden name (which is on her VISA and Passport) or her married name which is on the Marriage Lisence?

you do not need an SSN before you file for AOS. you can apply before or after you AOS. once your I-94 expires, then you'll have to wait till you have EAD or green card to apply for SSN.

2> What name do I file the AOS under? The her maiden name (which is on her VISA and Passport) or her married name which is on the Marriage Lisence?

she would file using her married name for AOS.
