Hello fellow Vjers,

I finally moved to California to be with my fiancé, now my wife, and now its time to get down and finish of the AOS and I had a couple of questions.

1) One of t he questions on the I-485 form asks “LAST ENTRY INTO THE US” I came from Canada, which is where they have the POE customs/immigration. Do I write TORONTO, Canada or San Francisco.

2) I entered as K-1 where can I get a list of physicians in the area who can transfer the relevant information from the vaccination supplement form. And also if anyone can tell me which form is it that they are supposed to fill out?

3) Also at the POE in Toronto, I asked the officer if I can get an EAD, but he said the I-94 authorizes you to work for 90days. Is this true? Because there is a policy

which states that K-1 visa holders do not need specific authorization, therefore an EAD for the 90 day period is not required….. or am I understanding it wrong.

Timeline

You entered USA in San Francisco. Do a search for Civil Surgeons using the USCIS webpage - they have links to cities etc. I don't think you can work without an EAD or AOS - only New York Immigration office stamps an EAD in your passport allowing you to work. Good Luck

Theoretically, I believe, one could apply for that 90 day temp EAD that goes along with the K-1 if you didn't receive it at the POE. But, most likely you'd just end up paying big bucks and not getting it before the 90 days expired. Add to that that you most likely won't get your 1 year EAD within the 90 days, so you'd have to quit working while you waited for that one.

rahma's right - K-1'a are entitled to apply for an EAD but it last only 90 days, and given the current waiting times it would probably expire before you got it. The SSA's policy is about issuing social security numbers - basically you are legally able to work "with DHS authorization", therefor you can get a SS card, but can't work without the EAD. It seems the people at social security offices don't come accross this too often, as some offices do not let people have numbers even though they are technically entitled to one. I printed out that information from SSA.gov and showed it to the guy at the social security office and managed to convince him.

As for the vaccination suppelement, its for I-693A, which is available somewhere online - I'm sure if you search through this forum you'll find a link. The civil surgeon should have this anyway. Make sure you call around to get prices for the suppelement, as it can vary greatly, and don't let them convince you that you need another medical - its not true, they just want their money.
