I beleive if you file for an EAD before you file for AOS, An EAD would expire when the I-94 expires. since it can take 90 days to recieve an EAD, that's why it makes no sense to do so with a K-1.

Can we apply for EAD separately before AOS to speed things up? If they approve the EAD before AOS filing, how long would the EAD be good for?

Filing for an EAD at any time does not *speed* up anything other than getting income.

If you apply for EAD prior to filing for AOS (which is code a(6) ) it is only good until the expiration of the I-94. It looks like you already have the stamp from JFK so this is useless. There are several threads in the Working prior to Greencard forum (which is where I will move this post to).

K-1 should apply for EAD WITH AOS, not before.

K-1 holder should not bother with getting (a )(6 ) EAD card, that card expires 90 days after entry on the K-1, and can take up to 90 days to get. A Useless card, and a waste of $340

EAD filed for with or after filing AOS is FREE, and results in a 1 year EAD, renewable for FREE if needed.

(A )(6 ) is for Fiancee before filing for AOS, this is the "TEMP" 90 day EAD that expires with the I-94.

A. K-1 Non immigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File your EAD application if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under (c )(9).
http://www.uscis.gov/files/form/I-765instr.pdf

I have read of MANY filers that got the (a )(6 ) EAD only to discover it expires when the I-94 expires, and others that had the I-765 petition rejected because they has an AOS pending, or the approval of the I-765 happened AFTER the I-94 expired.

2. Immediately, before filing for AOS. As a K-1 visa holder you are technically eligible to file for an EAD immediately when you arrive. However, this EAD will expire when you K-1 expires (90 days) and because of this and the wait time (>90 days) it is a waist of both time and money to bother applying. You will file as category ©(6), "Nonimmigrant Fiance(e) of U.S. Citizen".

So the US government is in the business of ripping people off? Over 300 bucks for a useless form that expires before you even get the EAD? That should be illegal!

I would say the processing time is at fault, not the underlying system.

But if the processing time is a result of the system, then the system would be the problem.
