Okay, I have the i-134 now. Do we really need tax returns/W-2 (or whatever it was)? The form says we need them if he is self-employed. So I just want to make sure!

They want good financial evidence of income, IRS returns are excellent evidence of what income was for prior Year, you can use IRS transcripts, in place of the returns. (1040 is a return the W-2 is a form provided by employer that has the numbers used on the 1040, the 1040 needs the W-2 to prove the numbers on the 1040(Return).

The directions included with the I-134 are quite old, and USCIS has not bothered updateing them because USCIS has no use for the form, only the consulates use the I-134.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

• I-134 signed and notarized.

• SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

• Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

• Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

• Photo copies of past month or so of pay stubs up to a few weeks before the interview.

My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

Also consider this you WILL have to provide the IRS return data later for the I-864 used for adjustment of status.

I believe you do not but I can see no harm in getting the extract from the IRS just in case. It might even make it a bit easier for the the person reviewing the information since the I-864 is legally binding (used for immigrant visas) and requires the extract and the I-134 isn't and doesn't since it is for the K visa. (I may be mistaken on this but I think that's correct.)

YuandDan are correct about the I-134 being a mini I-864, USCIS takes it rather seriously, better to have something and not need it instead of the other way around.

Ditto. Better safe than sorry - get the transcripts or the returns (copies).

I just looked up the info on the I-864. It states in the section on how to fill out the form that you need the most recent tax return. "If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years." So you really only need the most recent year.

Get the IRS to fax you the info. They still do that last time I checked and I have heard of people getting theirs in three business days. Lisakopavi is right about the availibility of the most recent year's tax return but at this time of the year the tax extract for the most recent year should be available from the IRS. They become available six months after the tax filing deadline (April 15). Time is tight so take a photocopy of the 2006 tax return with you, just in case.

Thanks everyone. He sent me the past 2-3 tax returns, the W2 thingie, and copies of paystubs from the past month or so in the mail yesterday. So hopefully I receive them by Monday...

Worst comes to worst, they won't deny ur visa, they wil just hold it til u got the paperwork, so its not the end of the world, but glad u got it prior.

I only knew of one other VJ'er with an interview date of Oct 17 - now there are 3, wow! I guess Oct 17 will be almost as busy a day in Montreal for VJ'er's as today was with 4!

Oh! It didn't even occur to me that I could possibly call my fiance immediately after the interview is finished to tell him the (hopefully) good news if I am approved! I was thinking I'd have to wait til I got back to my city from Montreal - I'm a few hours away...
