K1 Visa - How long do you have to wait for NOA1 notification? Our lawyer told us 6 mts?

HI just wondering how long we could be waiting for NOA1 notification. We have a lawyer in AZ taking care of our K-1 process due to me being denied a student visa and a tourist visa previous to our K-1 application...I have never overstayed any previous visa or done anything wrong but they decided to deny me student and then tourist visa.

Does anyone know how I would go about trying to visit my fiance in America even though I have 2 denial stamps on my passport? I am Irish. Surely it is ridiculous that I cannot visit my fiance in america? As a result of me not being able to travel to see him he cannot keep a regular full time job because he has to come here to see me.

HELP US!!!

Depending exactly when you filed, NOA1 can take 2-8 weeks to arrive. If you have a lawyer, your NOA1 was most likely sent to your lawyer.

Its not ridiculous. About 50% of those illegally residing in this country came in on a valid visa. So if you show any immigration intent (without the correct visa), they wont let you in. No matter where you are from. In order to visit, you need to show that you have ties to your home country and that you intent to return. Having a job, lease or mortgage helps with that. Not working and/or living with your parents is going to make it very difficult.

Your fiance will need a regular job in order to meet the support requirements. (Or enough assets to make up the income difference)

I was thinking the same, until I learned what is most correctly quoted above. The American sponsor can freely travel to visit. However, it doesn't work the other way around.

It only took a couple weeks for our NOA1. (That's the quick part.) Didn't take 'em long to cash my check either. ;)

However, if he cannot hold a regular job then it is possible for him to have a Co Sponsor, such as a Parent for example.

If you have been denied a student visa and a tourist visa, I wouldn't suggest pressing it again while you have a fiance visa application in process. Generally the NOA1 is received 2-3 weeks after the application is received at the service center. If you are using an attorney, I would contact them first to find out if the application has been sent. The time period doesn't start until they send it in. That might be why your attorney said 2 to 8 weeks, to cover up their slowness.

Once the application is receive you generally have a three month waiting period before they actually start the processing. The application process isn't very long and assuming everything is in the package, it will be shipped to the National Visa Center (NVC) in New Hampshire. The processing there depends a lot on the country of the applicant but often the process is over in one to two weeks. Then your file is shipped to the U.S.embassy with jurisdiction (your country) where the visa control staff continue the processing. You should look at the embassy reviews for your situation to judge timelines.

It is probably easier for your U.S. resident to visit than it is for you, especially considering your recent denials. More than anything you will need patience.

I don't understand why you're having problems visiting if you're Irish. Can't most Europeans come with a passport that automatically becomes a tourist visa? I know this is how it has worked for my fiance who is British and a good German friend of mine. It also works for Americans go to Europe like this: Your passport serves as a tourist visa.

Regarding the NAO1: six months is wayyyyyyyyy toooooo long. It should only be a couple weeks. We submitted ours when there was a big mess up at the service center and it still didnt take longer than a month. What have they said is your reason behind getting denied these visas?

I'm sorry the U.S. hasn't let you come to visit. They wouldn't let my fiance in either, but he's from a developing country. Unfortunately, being from Europe doesn't guarantee an immediate visa approval. I know of a guy from Denmark who tried three times to visit the U.S. and was denied. His girlfriend had to go there to visit him until they got their fiance visa.

Don't let it get you down. The U.S. government just doesn't make sense sometimes.

It shouldn't take that long to get the NOA1 though. Most take about 1/2 the time your attorney told you. Just keep in touch with the attorney - check up on them because sometimes they don't keep on top of things as fast as you would want them to.

It should not take 6 months to get your NOA. It usually took 2-4 weeks, but I understand things will be seriously delayed becuase of the increase of application to beat the new fee schedule at the end of July. Can't say how much. But even prior to the fee change announcement, USCIS was having a major problem mailing notices...by the time I got my NOA2 (after much complaining and Senator involvment-only because we need it for AOS, they never mailed, and we're trying to charge me over $200 to print and mail) he was in the US and we were married!

If you're going through CSC, which it looks like you are, then you can expect your NOA1 to take about a month to 6 weeks. THe 6 month figure your lawyer is giving you is, I believe, the "don't bug us before this long has passed" timeframe that USCIS quotes.

If you fill in a timeline then visajourney will give you an estimated date for the NOA2 which is pretty accurate.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment
