I sent out AOS, AP and EAD for myself and AOS and AP for my son back 07/28/07 old fees received by USCIS 08/01/07. After an infopass on 09/20/07 my package was found and I received a call from the local office telling me that they were going to put my package through but that my sons would be sent back due to lack of signature. I had signed under Part 5. Signature of person preparing form and not under Applicants Certification as my son is only 9.

Today I checked and all of the checks have been cashed (mine and my sons)... I'm assuming that they have decided to accept the applications for him ... am I assuming correctly?

First you should sign for your son, on the signature line, because he is not of age. My wife had her son sign and then she signed next to his signature as his parent. USCIS accepted his application that way.

I am uncertain about your assumption. Because you did sign as the preparer that should preserve your son's date and fee. In our case, when USCIS returned my wife's son's form for correction the filing date did remain the same and therefore the fees should be the same.

At long last! Congratulations! I'm sure they've figured it out that you're supposed to sign for your son as being a minor.

What a relief, isn't it?

I'm excited that they cashed the checks .. but I'm still fearful that they may still send my sons package back to us.

Now if they just started processing our packages (because I'm sure that it was "misplaced") what will our NOA's date read?? ... will the processing times read two months after they received the package? or will they rush it through for EAD to be processed within the 90 days along with the AP's?

I guess the NOA date will be the day they opened your package and put it in their pile of cases to be processed.

So I went to the infopass appointment and I must say that they are very friendly there.

They looked up my file using my MSC #'s and they told me that mine was fine but that my sons was not in the system ... until the officer decided to do a little more digging on his computer. He found my son and wrote out all of the correct MSC #'s attachd to all of our applications for me which I thought was very nice. He was baffled that they put my sons through and the officer that had told me that they were going to send my sons back said "they lied to you" (exact words).

As for the wrong code on my EAD application ... they told me that I would have to wait to see what they are going to say about that ?? that they couldn't forward any corrections to the application.

I asked about emergency advance parole for my son as his grandfather is very ill with cancer and will be undergoing radical chemo and then a donor white blood cell infusion shortly after and the officer couldn't give me a definitive answer even if I had proper documentation from my sons grandfathers physician.

The officers seem to be just as confused about how USCIS processes things and seem to have their hands tied about alot of issues. That just seems to be the impression that I got.
