Good day everyone,

I was wondering if you can help me with my question. I need to know if my husband can go for both the K3 and IR-1/CR-1 visa? When I originally applied for him, I did not know much about the K3 visa, so in the I-130 application where it asks you where you want to apply for adjustment of status I typed "Ciudad Juarez, Mexico"...which is consular processing. After I got my receipt for my I-130 I submitted the I-129F application. I know have a receipt for each. If he comes here on a K3, can he still go back to Mexico and get the IR-1/CR-1 visa? It just seems easier to go back to Mexico for this appointment instead of doing the AOS in the US and WAIT and wAIT for an appointmentg and then to get the Permanent Resident Card.

7.14.07 - Received NOA1 (WOW after 6 weeks, I was worried...called INS and told me CSC had a computer "glitch" causing delays on printing Receipt notices and approvals)

10.30.07 - APPROVED No email, the NOA2 came in the mail...hard copy.

7.23.07 - I-129F received in Chicago

7.30.07 - Received NOA1

11.21.07 - APPROVED!!!! APPROVED. GOT AN E-MAIL ON THANKSGIVING!

03.03.08- INTERVIEW IN CIUDAD JUAREZ. VISA GRANTED ON 03.03.2008

***AOS & EAD***

3.10.08 - Case Received at Chicago Lockbox, check cashed 3.14.08

3.17.08 - Received both NOA's in the mail

3.21.08 - Received Biometrics appointment letter in the mail, biometrics Appt. 4.02.08

5.05.08 - EAD Card Production ordered GOT EMAIL (we received the same email on 5.09.08)

5.13.08 - Approval Email for EAD (so the card was ordered first, and then we were approved...hum)

5.15.08 - EAD Card Received in mail.

8.08.08 - WE GOT OUR INTERVIEW APPOINTMENT YAY...9/12/08 - INTERVIEW APPROVED

9.24.08 - Received Green Card in the mail YEAH!

***I-751***

6.15.10 - Mailed I-751 Docs to CSC, check cashed 6.24.10

6.26.10 - Received NOA in mail dated 6.21.10

6.29.10 - Received Biometrics appointment for 7.15.10

That's the way to do it with the cost and hassle of doing the AOS for K visas now.

Don't know what effect you typing adjusting status in Mexico will have on the I-130 process tho.

I don't think you should have filled that part out if your hubby wasn't in the US.

Hopefully your service center won't hold the I-130 and send it to NVC for processing.

IR-1 if you've been married for more than 2 years

CR-1ess than 2 years.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

All evidence so far, would suggest that simply writing the name of a Consulate abroad is not sufficient as a clear enough request for Consular processing to keep the I-130 from being held. The assumption is that if you file an I-129F, you are following the K3 path.

Facts are cheap...knowing how to use them is precious...
