Name on AOS forms

Now that we are in married, and I am ready to file the AOS documents, what last name do I use for her in the forms? The name in her passport. or my last name?

The same question for the SSN. Can she use my name, or her name as in the passport?

Married name is ok (and I'd say better) to use straight away. Your marriage cert is a proof of name change. Same for SSN. And for biometrics down the track. As long as she remembers to carry her marriage cert with her along with the passport.

In my state the marriage license allows legal name change and my Wife took my family name.

We filed AOS using married name, and on the line that says name on I-94 we put maiden name.

Her Green-card has her married name.

If you file using maiden name, and later after getting the green-card yu decide to change the name on it, you will need to file I-90 and pay $340 to change the card.

I think it varies from state to state and personal situation, but we followed the process below:

1. Got married (her maiden name on wedding certificate that came in the mail 2 weeks later)

2. Got SS Card (She took my last name during the application process for her card)

3. Filed AOS/EAD using my last name, which was now her last name

We got married, then applied for SS with her married name. Once we had the card in hand, completed AOS documents.

When I filed the AOS forms, I used her new married name.

In order to change the name in the Passport (BRASIL), she needs to register our marriage with the Brazilian Consulate before being issued a Passport with her married name.

I used my married name to file the forms. I don't understand the use of "legal name". Once you are married, if you take your husband's name, that is your legal name if that is what that comment means.

If your wife has taken your name than she needs to file in that name. If she wants to keep her maiden name than she can file in her maiden name.
