Hello Everyone,

I am getting ready to file our AOS. I have reviewed the Fee Schedule and see that the AOS,(485) is $1010.00. I always thought that the AP and Permission to work were included in the $1010.00 payment. However there are different fees for these items. Am I wrong that it is included in the AOS Fee, or do I have to add it to the $1010.00? Sorry ahead of time if I didn't read far enough into the fee schedule.

Thanks,

Yes, the EAD and AP fees are included in the $1010, but you need to file for EAD and AP at the same time (i.e. throw the applications in the same package as your I-485).

Excerpt from the instructions to form I-485:

NOTE: Effective July 30, 2007, if you file Form I-485 to adjust your status as a permanent resident, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently. If you choose to file the I-765 and/or I-131 separately after the effective date, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

So if you don't file I-765 and I-131 at the same time as I-485, you can still avoid paying the fees for those by waiting for the NOA1 for your I-485, and then attaching a copy of that with your I-765 and I-131 applications.

Thanks Shub,

I started reading some more and found out what you just told me. I should have took the time and read more before I posted. One more question; can I use the same G325 that I used for the K-1 petition for the AOS filing? I already have the 325 complete from the K-1 filing.

Thanks again.

I'm not sure what you mean by "the same G-325". G-325A is a form that is used for a lot of things at USCIS, so it will always be the same.

Of course you need to submit an original G-325A in 4 copies with your I-485 -- in my logic, you would have sent your originals with your I-129F petition, so you would only have copies left. The ones you file with your I-485 application can't be photocopies. Plus, I do believe the G-325A asks for the applicant's A number, and possibly their SSN, which is not information you would have had at the time of filing the I-129F form.

I would suggest you just fill it out all over again -- of course you can simply copy the information that hasn't changed from your first G-325A. It's important that the signature is original and not photocopied, which is why you have to fill it out all over again from scratch.

Thanks Shub,

Yeah you are right. Besides the information on the G-325A has changed again since the K-1, she has a new residence to add to the list...in America. :) Thanks for you help.

Effective July 30, 2007, if you file form I-485, no additional fee is required to also file an application for employment authorization (I-765) and advance parole (I-131) if you file these forms concurrently.
