So...

my husband and I are getting ready to petition for his CR1 visa on a DCF in Brasil within the month. But yesterday he got a job offer in New Zealand. He wants to go and work in New Zealand in the time between the first interview where we petition and the second/final interview in Rio. I have reservations about this whole plan because I don't know if that would make us ineligible to do the DCF in Brasil if he were to leave Brasil on a temporary work visa.

Any thoughts? I also heard something about New zealand, that they are REALLY relaxed on their requirements for applying a DCF--like we could essentially land in New Zealand and do the DCF in New Zealand if we wanted to. Is this true?

-thanks

If I were you I would check it out with the consulate in Brasil and the consulate in Auckland. You don't want to be in a situation where you are almost through the process then find out they won't interview you or reject your application.

This happened to a couple in Canada recently. They were waiting out the processing time in Canada, she a U.S. citizen, he a UK citizen. After all the paperwork was finished at the NVC they found they were not eligible to interview in Canada as they were only here 'visiting' - they had to go to Ireland to interview (a bit of an apples and oranges example - just an example of the fact that it can be tricky).

What will his status in NZ be? Will he fit the criteria of having permission to stay longer than 6 months?

The Auckland consulate states:

Can a third country national (not a permanent resident of New Zealand) apply for an immigrant visa in New Zealand?

In some cases. First, that person must show that they have permission from the New Zealand Immigration Service to remain in New Zealand for 6 months or longer. Depending on the immigrant visa category involved, it is possible that we would accept that person's immigrant visa application. In general, however, the person must have some ties to New Zealand; that is, some reason for being here beyond applying for the visa. link

Perhaps some kiwis will come along and give you their personal experiences - but it seems like a big risk to me. I know for the Canadian consulate you have to show proof that you have permission to remain in Canada for at least 6 months (and they want the documentation to back that up).
