I-129F approved...cancelled? argh

Timeline

My wife and I have had nothing but problems with the immigration process. My mom decided to help out and get us an attorney. I gave her power of attorney and she ended up sending in a cancellation letter for our I-129F because she thought it was messing with our I-130. 2 days after she sends the letter I get an email that our I-129F is approved. So are they going to cancel the I-129F or is there still a chance to save it?

I called CIS and they said they can't do anything. Would sending another letter only mess things up more? Or will seeing an officer in person help?

I need to get my family here ASAP. We now have a daughter who has health problems and she is not getting the care there that she could be getting here. Every day she remains there is a day she falls behind developmentally :(

I see so many problems get posted to this board that lawyers cause.

Filing an I-129F does not slow things down in K-3 cases, it tends to cause USCIS to hold or even recall I-130 petition from NVC, assuming the couple want to pursue the K-3 and then adjust status in the USA.

Filing to cancel the I-129F may cause them to cancel the entire petition I-130 and I-129F, though.

I can't stand overpriced idiot lawyers :angry: Sorry, I don't have an answer. Just throwing in my two cents :blush: Probably at least half the people in visajourney know more about the immigration process than so-called "immigration expert lawyers", like the one that I hired. I would recommend using visajourney for the rest of your....well....visa journey, as opposed to your lawyer. I quit communicating with and having my lawyer fill out paperwork about two months into the process when I realized everyone here knows more than her combined with the fact that it takes her at least a week to respond to voice messages and emails...if I ever get a response.

Anyway, I wish you and your family luck in getting your daughter here ASAP.

Yea, I hired Murthy Law firm, I filled out all the forms and after two weeks when I asked her when I she will review my case, she said in a week and suggested I pay an additional $750 if I want her to look at it earlier. I realized I just introduced an another bureacratic layer to the process decided to do it on my own. She charged $1000 bucks, even though she didn't even look at my file yet.

I am never hiring that firm again for anything. Forget the $1000 atleast I saved lot of time doing it on my own, instead of using the law firm. They are nothing but over priced paper pushers.

Your lawyer should be disbarred.

If both petitions were filed correctly there won't be any problems in regards to one affecting the other.

If she blew it on the original ones saying you were going with the K3 then the I-130 may get held up or returned to the service center.

K3 and CRs are 2 COMPLETELY separate visas. Only thing in common is you will need I-130 approval [initial petition']to adjust atatus for the K3 when you get to the US.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

If it takes CSC as long to open and act on the letter as it does for them to receipt the I-130 petition you may be in luck. I would suggest calling USCIS or making a quick infopass appointment to see what your options are.

I have an infopass appointment setup already. With my luck opening the letter and acting on it will be the only thing they do faster then a snail :(

Same thing happened with Holmes and Lolly. Scumbags. They ended up getting me for a grand but wasted 4 MONTHS of our time "preparing" documents only to ask for everything again and require all sorts of stupid signatures. Anyway to make a long story short they are scammers. When we asked for a refund the partner "Lolly" responded that they don't issue refunds. But if my wife wanted to marry another foreigner they would handle that case. A$$h0lez.

I know its a mute point now, but you have to remember that immigration lawyers have a business too. Its sad to say, but a lawyer doesn't care much about your personal case more than their "stats" or monetary gain on processing cases. Go to any immigration lawyer's website and just see the advertisements "over 1,000 cases processed in 2006" and read into that statement carefully. With most cases, they only see dollar signs for easy cases. I don't know too much about the immigration process, but as a few on here have said, lawyers in the immigration process tend to make things worse. I think lawyers are really only good when you have a highly complicated case or special circumstances. Judging by previous bulletins and other sites, I would say 90%-95 of all immigration cases are routine and don't require any extra help.

10/15/2007--NOA2 Date, FINALLY!!

05/23/2007--NOA1 date, currently at NBC (MSC)

12/12/2007--interview in Lima, Peru...VISA APPROVED!!!

Oh my...

We have two children as well. I can feel your pain.

Ours took long time to get approved, too.

The reason that ours took so long was that ours went to FBI's "extended review" for name checks.I

I heard that it could take for over a year.

Once we thought about sueing USCIS for taking so long to make decisions. We contacted three laywers, and they said we have a good case.

Also, we contacted two congressmen, and Ombudsman. They work hard and help us lots. They called USCIS, wrote letters to the top of USCIS, and so on. They pushed USCIS so much for us.

Finally we got approvals.

I can tell you this, without their helps, ours haven't been approved yet even by now.

You should contact them to see what they can do, and also I heard that writing to the first lady will help as well

is your mom's name anywhere on the petition?? If you have an attorney and his/her name is on the form for representative and your mom's name is nowhere on the form, I think you should be safe. Only you, the beneficiary and attorney can inquire on this petition, no outside party. I hope everything gets worked out and hope your daughter gets better.
