We applied for both the I129F and I130 and both were approved. The I129F was processed and referred to the Consulate in New Delhi where my husband had his interview and the K3 visa was issued. He arrived in the United States, got his EA card and social security number. Lo and behold, the notice arrived stating that the I130 was complete and being referred to the Consulate in New Delhi for an interview. He is already here with K3 visa and AOS is in process.

What happens now? Should the I130 be stopped at this point and if so, how do we go about stopping it? Due to finances, there is just no way that we or he can return to India for the interview.

Please advise what to do as I am at my wits end.

You need the approved I130 for AOS. You should contact USCIS to have them not send it to NVC (using infopass as suggested is not a bad idea).

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

Did you send an I-864, two fees and a visa application to NVC over the past two or three months? Did the notice come from USCIS or NVC (National Visa Center)?

A timeline would have answered these questions. It's difficult to help you without a timeline.

Please advise how I go about contacting the appropriate office. I really don't know what to do and I don't want to mess things up at this point. Your help will be appreciated.

Ok, so even though she was already here on a K3 visa, you continued the CR1 process and paid fees for a visa you never intended to pursue, at the same time filing EAD and AOS. Interesting. At this point, you won't see any refund of fees paid to NVC, so you can just not show up for the interview and continue with the status adjustment. Your approved I-130 needs to get back to the service center so it can be used in conjunction with your AOS. I would notify DOS ASAP so your AOS isn't delayed any longer than it already will be.

To bad you already filed for AOS or you could go back and do the I-130 interview and not deal with all the BS and money that goes with a K3 adjusting status.

You may have ended up with the GC sooner and with a lot less hassle than you will doing the current AOS.

Don't know if you could do it now tho.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thank you for your advice. The continued processing of the CR1 and payment of fees was done through sheer ignorance on my part. I am surely ignorant on this!!! Please advise how to notify DOS to return approved I-130 to Service Center. Who is DOS? It was sent by the NVC to Delhi.
