a friend needs advice ASAP!

Timeline

Ok all...a friend of a friend is currently going thru the worst situation ever.

He met a girl whol lives here but is from Mexico, apparently she has worked as a nanny the past few years(yes illegally), now she has been back & forth to Mexico several times with no problem(not sure how) but she was detained on her last trip while trying to enter the US.

She apparently admitted to working here & the immigration officials had her sign all sorts of paperwork.

I told my friend that they need a very good lawyer ASAP. I know she will have an automatic ban for overstaying the visa & for working illegally but since they are a couple & have been for 2 years.....could they file for a K-1?? Or could they get married in Mexico & he can come here & petition to bring her here as his spouse?

I just feel for them & figured I could ask you guys for some advice. I know they need a lawyer, but I wanted to be able to tell them something.

It depends a great deal on what she signed as to what she will face in trying to unravel. At the least, re-entering without inspection after being in the US over a year without authorization can mean 10 years outside the US before they can even file a waiver.

A rule of thumb would be not to sign anything they ask you to sign admitting anything without a lawyer present (of course you are not able to have a lawyer present).

She should take copies of anything she signed to an attorney to review the situation on its whole.

I am assuming she panicked, as I mentioned this is a friend of a friend(actually the girlfriend of my friends brother) :blink:

they knew I went through a lot getting my man here but his case wasn't this complicated. Bottom line I told him he needs to get a lawyer asap. He is going to visit her next week in Mexico...thanks for the response
