The petition still must field, maybe as a military service member he can apply for a fee waiver. A judge granted them 1 year extension which Once he fiels the AOS her status will be fine all he has do is file the paperwork like everyone else.

I agree she should not be grouped in the same way as those who entered the USA ILLEGALLY, for those who entered Illegally they should be given NO Options other than deportation.

For her she was with her mother and given political asylum, she therefore entered legally and all they need to do is file her AOS.

He should file the paperwork get a fee waiver ( The Govt. knows that a 2nd class PO in the Navy does n't make very much $$ and with him having 3 dependants he will most likely qualify for a fee waiver.

He still needs to fiel AOS

There needs to be some consideration for his situation especially if he faces being deployed again.

Maybe he feels all the publicity will give her rights. lol.

All couples waitinig for their visas, screw the process, just call CNN and tell them your sad story!

The woman is a legal entrant to this country.

It appears the only 'illegal act' committed was not filing to adjust her status (based upon her marriage) soon enough.

It would be pointless to file for adjustment now as she has apparently already been issued an order for removal.

Don't know if anyone caught this but...her mother was granted legal status as a war refugee but...her daughter didn't wait the six weeks for that happen and got married. That is why her status is in question now. There is moral for us here....

agreed. i'm not real sure just why the government can't just make a ruling in her favor.

The Judge already made a ruling granting her a year extension, that is more than enough time to gather the correct documents and paperwork and File AOS, the Military has legal assistance avail. for spouses.

i'm thinking more of a permanent ruling rather than a one year. she came here legally and this is all about a technicality.

It's probably a pretty fixable problem if they can get the deportation order delayed or overturned. It sounds like once she was denied AOS based on her mother's petition, they put the gears in motion because now she's out of status (and 'illegal'). If he files for her now and they can keep her from being deported, she'll adjust just like any other spouse.

same here..so she probably thought all was well..

a sidebar..allot of miltary dependents..depend on the miltary for assistance and support..and i believe the miltary does a good job in most cases, except in immigration....where they offer little guidance

I absolutely agree with on this one we asked for help so many times all we had is some information , that you can get from the CIS website .

Been in the military it doesn’t not give in privilege to on top of other people , even if you are getting deployed , while filling for the K1 , they wont even speed it up , well I wish all the best for this family no one deserve to be separated from the people they love most .

The way I read the article, the mom applied in 2000 for legalization and included her daughter in that petition. Then, mom was approved in 2004. However, 6 weeks prior to mom's approval and 4 years after the original application was filed, the daughter married ... NOT that the daughter just had no patience and couldn't wait 6 weeks.

Jeez, I wish UCSIS would approve petitions after 6 weeks. That would be nice!

As a matter of fact, a deployment is a legitimate reason for an expedite of a petition or an adjustment of status.

I also found the article a bit confusing but will read it over again as haven't had much time. But concerning the military and immigration, there is definite need for better information considering that many do actually meet spouses while serving abroad. Our experience has been that the military offer much information on a lot of things but when it comes to immigration they don't know/want to know about it. Considering I met my husband after he had already served 15 yrs and many tours of duty abroad he was not ever made aware in any kind immigration laws if he ever met a foreign spouse.
