Immigration to USA (But ...)

Dear Sir

My name Susan Khalid ,I am a US citizen live whole my life in IRAQ . I got my citizenship by born in Colorado in 1977 and I stay in USA just only two months and then back to IRAQ and stay in it till know and I had new passport type P valid to 2015 I renew it from US embassy in Jordan.

This is my story:

I married in 23-Dec-2004 and I had one child (both my husband and daughter are IRAQI citizen).

The terrorist try to kill my husband because they know he is married a (US citizen) So I escape from Baghdad to Sulymainia north of IRAQ but I leave every thinkg in Baghdad (my house, my car).

I decide to travel to USA with my family ( My husband and My daughter),

but I see it must need a sponsor and I must fill the I-864 form!!!

But I'm not meet the minimum requirement of I-864 and I don't know any one in USA to be a joint sponsor or I can't go to USA without my daughter because her age is one year and half so she need alot of care.

So I need a way to travel to USA and live in peace and safe with my family? (Please I dont need link to web sites because I read them all , I need advise)

Dears

I go to Jordan and start my daughter case and they give finall apointment interver for her and they put a visa on my husband passport.

and back again to same problem visa to Jordan

I request for visa and wait 65 days to answer and they reject , I am afraid I losing every thing I do , because as u know the USA visa is valid for 6 months and if I request another visa to my daughter maybe it takes three month and reject it again.

what shell I do ?

I send email to us embassy told them that and I told them can I send documents by mail ie without interview.

I don't really think there is much more we can say to help you at this point. You have to work this out with the embassy that is doing the visa processing.

It is a shame you couldn't get all the necssary interviewing for you daughter done when you did get to go there. Yes, your husband now has 6-months to make his initial U.S. entry. However, if your daughter can't make her visa interview, they can simply reschedule it; it is not like starting all over again from the beginning. You did ultimately get the visa to Jordan for your daughter the first time, so why is it you cannot get it again now that you even have an appointment notice? You might be able to get your daughter's visa processing done without her reappearing, but again that is up to the embassy and based on your circumstances.

If you can prove you have citizenship to the United States and that your husband has a visa to the United States, then they shouldn't care about your daughter if you just fly into Jordan or go to the border. It is worth trying. My husband had to go fly there and take his chances, it worked the second time for him (via the airport). They let him in and he didn't have a US visa.

I need to know somthing the officer ask me why ur husband have CR1 ? and ur doughter have IR1 ?

they must have both IR1 , I think embassy in jordan not correct it from CR1 to IR1 because I fill the I-130 for my husband in 2005 after one year of marriage but I complete it 2008 it mean after 4 year.What can I do to correct this problem.

First, congratulations, Susan!

Second, your daughter is IR2 because she is your natural child, not a step-child based on a marriage less than 2 years old. It is an unusal situation which confused the inspector (since children of U.S. citizens born abroad are usually citizens at birth), usually the child is a step-child and so if the non-citizen spouse is a conditional entrant, so too is the child. It does not really matter anyway, as your natural child and lawfulyl admitted as a permanent resident, she is now a U.S. citizen under the Child Citizenship Act and should be getting a certificate of citizenship shortly. You can technically apply for a U.S. passport for her now if you want to with her foreign birth certificate, your U.S. passport, and the visa & passport stamp, though with the certificate of citizenship it will be easier for Department of State to process the passport application (you don't need to get her a U.S. passport, however, unless you plan to take her out of the country, which I doubt given your circumstances). If they send her a Permanent Resident card, it is a service error and you may need to file Form N-600 if you want the proper ceriticate, possibly requiring you to pay a fee even though it is their mistake (you don't need to get the certificate, as a U.S. passport is legally equivilant to a certificate of citizenship, but it could be helpful to have).

Third, yes, your husband should ultimately be admitted into IR1 category. It does not matter when the petition or visa was issued, if the marriage was more than 2 years old on the date he was lawfully admitted into the U.S. for permanent residence, conditional status does not apply. There is nothing to do to correct the problem until he gets the Permanent Resident card. If the Permanent Resident card says CR1, then you'll have to file a form I-90 with no fee and a copy of the marriage certificate with translation to correct the service error, and they will process him for a new card in the proper IR1 status (which will take some time).

Hi Dears

Can I know when the green card arrive I entered US in 7-feb 09 and till nothing I got for him or for my daughter???

we only get the SSN .

Did he receive a Welcome letter? You can use that to check online if the card has been produced and sent to your address (did you add his name to your mailbox? SOmetimes they will return it to the service center if the name was not on the mailbox). You can call the info line with your case number and inquire about the card. Or, contact your congressperson to follow up on card issuance with the USCIS - they get better info than the mis-information line.
