Wow you have been in the US 5 years already and are in a custody battle so you have a child together? Do you have a green card? Have you filed for AOS? Why does your husband think he can have you deported?

Me and my husband currently on divorce and a costudy battle and he is now trying to deport me out of the country.Can he do that ?Im really worried because im still not a US Citizen . :help: i dont know what to do......

Need more information in order to state whether he can influence USCIS in this matter, but if there is a child involved, since you mention that you are in the custody battle, then he'd have a difficult time demonstrating that the marriage was not bonafide, with a simple allegation. Children born to a marriage of an alien and a USC is a pretty good form of evidence.

I think we did Filed AOS. I have a 10 year green card

Sorry but what you have said isn't clear.

You "think" you filed for AOS.

What about filing for removing conditions? You would have had to file a I-751 to get a 10 year GC.

Since you have the 10 year GC.

Unless you've commited a crime or done something that could result in deportation. Your hubby can't get you deported.

Then there is nothing to worry about, you just renew that card in 2016, by fling an I-90, or you can apply for citizenship I believe in 2011, if you are not married.

Then there is nothing to worry about, you just renew that card in 2016, by fling an I-90, or you can apply for citizenship I believe in 2011, if you are not married.

Unless you're involved in some criminal activity, it would appear your husband's threat of deportation is an empty one. You do not need any further connection with him to stay in the US, since you have permanent residency. What you last filed for was to remove the conditions on your original 2 year card, in order to get the 10 year card. Obey the laws and enjoy your life in the USA. You are a legal permanent resident.

Just because you were granted a ten-year card doesn't make it so, sometimes! I have heard of some instances where K1's have been falsely granted a ten-year card and not known that they still needed to lift conditions, but she's not even at the stage where she would be due to file for that yet.

Never2Much, it sounds like you are in legal status right now, so that's one less worry. One place to start for advice on your case might be your local Catholic Charities; your local office is Dallas, so maybe look here and get in contact with them.

No further connection with him required, but he is still involved in her permanent residency as a sponsor.
