First, let me say CONGRATS to everyone who has progressed onto the next level!!! I'm really happy for you and look forward to the time when I can post that we're onto the next level as well. I have a QUESTION! I hope someone can reply to me.. (as i've posted a couple other questions on here and noone has answered them) even if it's just to tell me that no you've not heard of such a thing!!!

I rang the USCIS in Vermont tonight in regards to the RFE I sent back, they said, (and I must note the two times I've spoken with someone from there they have been absolutely SMASHINGLY nice!!! Such lovely people!!!) Anyway, they said that they definately have my application and are working on it, that it's not necessarily being held up or delayed due to my not sending that one paper, as they have everything now, but that they're checking it to see if we have proven our case that we are a genuine couple and that perhaps we won't even need to have the interview!!!? Is this possible? I mean, we've been living together for the last four years, sent bank statements/ rental agreements, etc. with all our information proving our relationship.. but I've never heard of not needing to have an interview.. Anyone have any thoughts on that??

Could it really be that simple even though it's taking longer due to that stupid piece of paper not being in with the original documents?!! I'd love to hear from anyone who has any ideas to this.. fact or fiction! It's put me a little bit higher on the optimism level at least for the moment! :D

Also, I have never heard of not having an interview. .. but I guess anything is possible.

Hmm, Halle - that would be awesome...but no, I definitely have never heard of anyone being exempted from the interview before in a K-1. As far as I know it's mandatory for everyone. But, keep us posted if it turns out otherwise!

I have heard that sometimes you don't have to do the interview for Adjustment of Status, maybe the person you were talking to was confusing those two stages of the process? Just a thought...

I can't imagine they will really give you the visa without an interview. The interview for you will probably be pretty straightforward--almost to the point of being a formality--but there are several additional forms (along with supporting evidence) that you submit to the consulate or embassy, and really, USCIS is not supposed to be looking at anything other than whether you are both free to marry each other, you've met in the past 24 months, and the USC is really a citizen, which means the consulate gets to evaluate that regardless of how obvious it is to the USCIS folks that you have a genuine relationship.

In all honesty, it sounds to me like she was making up an excuse for not having processed it sooner. The good thing about that is that it may also mean she recognizes that it really should have been done by now and will get on it right away.

Sorry if that isn't exactly what you wanted to hear. And the proviso is I don't really know that for a fact, but it doesn't sound very credible to me.

That makes sense. Probably more than my explanation (Meridien is probably less cynical and suspicious than I am). Halle, do you know if you were transferred to an actual immigration officer? The only time I ever called the 800 number for USCIS, the person I talked to knew less than I did, and this was pretty early in the process (before we filed).

Ahhh, thanks to those who have replied about it already!! I figured it was too good to be true! At any rate.. I really hope it goes by fast.. it's been two weeks since I sent the paperwork in.. and I sent it back within only two days after they sent me the request for more info. Urgh!! :D I shall keep a smile on my face though and be as optimistic as possible!! Being any other way is just useless! Thanks again!!

Well, they seemed to know quite a bit about the case, asked for my receipt number, etc.. .pulled up the file on their screen and basically said what I already knew regarding where the case was at but said it was DEFINATELY being dealt with atm. Now whether they have got to say that just to keep the peace, I don't know. I've not had any touches since the 26th of Feb.. so to me, it's hard to see that it's actually being looked at.. *shrugs* I'm not a 100% sure if I was transferred to an immigration officer, he gave his name and his number, whatever that means! :D Thanks for your reply!!!

Where did you mail it from, Halle? Was it from the UK? I'm in the midwest and mail from here to Laguna Niguel can take over a week. When I lived in Europe, mail from my parents could take as much as 3 weeks. I wouldn't be too worried about the delay at this point. I kind of wonder whether she actually checked that the paperwork had been received, though.

In that case, it sounds like they were at least able to look up your specific case, whether it was the person working on it or just a customer service person, so that seems promising at least.

I sent it via DHL next day delivery from here in the UK.. so they had it two days after I received the request for info.. had an email stating that they received the paperwork, that's not a problem.. I was just hoping that the issue would be quickly resolved as we sent it back so fast.. thinking it would help move the process along faster.. *shrugs* =/ I begin to wonder that as well, whether they check the paperwork they receive.. !! After four months of them having all our paperwork they THEN tell us that something is missing!!! How irritating!!!
